<br />88- 106122 <br /> <br />5. Sidewalks. The Subdivider, if still the owner of the <br /> <br /> <br />land in the proposed subdivision, or if the Subdivider shall have <br /> <br /> <br />transferred title to the property, then the various grantees <br /> <br /> <br />thereof, will install, at their own expense, all public sidewalks <br /> <br /> <br />as required by the Grand Island City Code when the lots are built <br /> <br />upon. Lot One (1), which contains an existing structure, shall <br /> <br />have sidewalk installed within one year of the signing of this <br /> <br />subdivision agreement across the total frontage in compliance with <br /> <br />sidewalk requirements. <br /> <br />6. <br /> <br />Flood Plain. <br /> <br />since the subdivision is in the flood <br /> <br />plain, all structures constructed shall have the lowest floor <br /> <br />elevation to a minimum of one foot above the elevation of the 100- <br /> <br />year flood as determined by the building permit received by the <br /> <br /> <br />Subdivider or successor from the Building Department under the <br /> <br /> <br />provisions of Section 2-1506.06, R.R.S. 1943. No basement shall <br /> <br /> <br />be constructed in connection with any structure in the flood plain <br /> <br /> <br />unless such basement is floodproofed and certified as such by a <br /> <br /> <br />qualified reqistered engineer or architect. <br /> <br />7. Easement Encroachment. An existing 8' x 12' accessory <br /> <br />building is presently located partially within the eight foot <br /> <br /> <br />easement which is being dedicated along the easterly side of the <br /> <br />property. <br /> <br />It is understood and agreed that the Subdivider or <br /> <br />successor(s) may maintain said accessory building in the easement <br /> <br /> <br />at her own risk. The Subdivider and successor(s) waive any claim <br /> <br /> <br />for damages against the City of Grand Island, its officers, agents, <br /> <br /> <br />and employees, and independent contractors for any damaqe or injury <br /> <br />3 <br />
