The Subdivider and successor(s) shall indemnify <br /> <br /> <br />and hold harmless the City from and against any and all loss and <br /> <br /> <br />damage and any and all claims, demands, suits, liabilities, and <br /> <br /> <br />payments in contract or tort, penal or otherwise, reSUlting from <br /> <br /> <br />or in respect of the use of the easement for the aforesaid <br /> <br /> <br />purposes. This license shall take effect upon execution of this <br /> <br /> <br />agreement, and shall continue for an indefinite term; provided, <br /> <br /> <br />that either party may terminate this license at any time by giving <br /> <br /> <br />the other party six months written notice. <br /> <br /> <br />8. Warr.antv. The undersigned owner, as Subdivider, warrants <br /> <br /> <br />that she is the owner in fee simple of the land described and <br /> <br /> <br />proposed to be known as CARLYLE SUBDIVISION, and that an abstract <br /> <br /> <br />of title will be submitted for examination, if necessary, upon <br /> <br /> <br />request of the City of Grand Island. <br /> <br /> <br />9. This agreement shall run with the land and shall be <br /> <br /> <br />binding upon and inure to the benefit of the parties hereto, their <br /> <br /> <br />successors, assigns, heirs, devisees, and. legatees.
