<br />88- 104068 <br /> <br />accurate map and plat of such proposed subdivision to be known as <br /> <br />PARK GARDENS FIFTH SUBDIVISION, designating explicitly the land <br /> <br /> <br />to be laid out and particularly describing the lots and easements <br /> <br /> <br />belonging to such subdivision, with lots designated by numbers <br /> <br /> <br />and easements by dimensions, and proposes to cause the plat of <br /> <br /> <br />such subdivision when finally approved by the Regional Planning <br /> <br /> <br />Commission and the City Council to be acknowledged by such owner, <br /> <br /> <br />certified as to accuracy of survey by a registered land surveyor, <br /> <br /> <br />and to contain a dedication of easements to the use and benefit <br /> <br /> <br />of public service utilities forever. In consideration of the <br /> <br /> <br />acceptance of the plat of PARK GARDENS FIFTH SUBDIVISION, the <br /> <br /> <br />Subdivider hereby consents and agrees with the City of Grand <br /> <br /> <br />Island, Nebraska, that it will install or provide at its expense <br /> <br /> <br />the following improvements: <br /> <br /> <br />1. Residential Development. The proposed subdivision con- <br /> <br /> <br />stitutes a planned unit development, pursuant to Section 36-27 of <br /> <br /> <br />the Grand Island City Code. For that reason, the Subdividers <br /> <br /> <br />agree that the continuing requirements of Section 36-27 of the <br /> <br /> <br />Grand Island City Code pertaining to residential development <br /> <br /> <br />under the planned unit development will be complied with by the <br /> <br /> <br />Subdivider. <br /> <br /> <br />2. Streets. The Subdividers waive the right to object to <br /> <br /> <br />any paving or repaving districts of Stolley Park Circle where it <br /> <br />abuts the subdivision. <br /> <br /> <br />3. Water. Public water service is available to the sub- <br /> <br />division and the Subdivider agrees to connect each unit in the <br /> <br /> <br />subdivision with a separate line to the public water service <br /> <br /> <br />before applying for an occupancy permit. <br /> <br />".... <br /> <br />2 <br />
