Public sanitary sewer service is <br /> <br /> <br />available to the subdivision, and the Subdivider agrees to <br /> <br /> <br />connect each unit in the subdivision with a separate line to the <br /> <br /> <br />public sanitary sewer system before applying for an occupancy <br /> <br /> <br />permit. <br /> <br />5. Drainaqe. The Subdividers agree to continue to grade <br /> <br /> <br />the lots of the subdivision in conjunction with the structures <br /> <br /> <br />thereon so that storm water drains to the pUblic right-of-way. <br /> <br />6. Sidewalks. The Subdivider, if still the owner of the <br /> <br /> <br />land in the proposed subdivision, or if the Subdivider shall have <br /> <br /> <br />transferred title to the property, then the various grantees <br /> <br /> <br />thereof, will install, at their own expense, all public sidewalks <br /> <br /> <br />required by the Grand Island City Code when the lots are built <br /> <br /> <br />upon, and sidewalks shall be regulated and required with the <br /> <br /> <br />bUilding permit for each such lot. <br /> <br /> <br />7. Flood Hazard. Since the subdivision is in the flood <br /> <br /> <br />plain, all residential structures constructed in the subdivision <br /> <br /> <br />shall have the lowest floor elevation to a minimum of one foot <br /> <br /> <br />above the elevation of the lOO-year flood, as determined by the <br /> <br /> <br />building permit received by the Subdivider or successors from the <br /> <br /> <br />BUilding Department under the provisions of Section 2-1506.06, <br /> <br /> <br />R.R.S. 1943. No basement shall be constructed in connection with <br /> <br /> <br />any structure in the flood plain unless such basement is flood- <br /> <br /> <br />proofed and certified as such by a qualified registered engineer <br /> <br /> <br />or architect. <br /> <br /> <br />8. Warranty. The undersigned owner, as SUbdiVider, <br /> <br /> <br />warrants that it is the owner in fee simple of the land described <br /> <br /> <br />and proposed to be known as PARK GARDENS FIFTH SUBDIVISION, and <br /> <br />3 <br />
