<br />200606199 <br /> <br />pass with the title to every Lot. <br /> <br />ARTICLE VII <br />EASEMENTS TO LOTS <br /> <br />The Association is hereby granted an easement, including right of ingress and egress, over and upon <br />all portions of all Lots which are not covered by buildings or which are not designated as private for <br />the exclusive purpose of caring for, maintaining and keeping up the lawns, trees, drives, walks and <br />shrubs located upon the Real Estate, including the right to install and maintain underground water <br />pipes. The easement shall be used only the officers and employees ofthe Association whose duties <br />require them to use it and the easement shall not be deemed to be granted to any individual member <br />ofthe Association. Every Lot Owner shall have a temporary license to enter upon such portion of an <br />adjoining Lot if necessary in order to accomplish repairs, maintenance, or construction of the <br />residence on the Owner's Lot. <br /> <br />ARTICLE VIII <br />COVENANTS FOR MAINTENANCE ASSESSMENTS <br /> <br />1. Creation of the Lien and Personal Obligation of Assessments. Each Owner of a Lot <br />shall pay to the Association: <br /> <br />a) Annual assessments or charges; and <br /> <br />b) Special assessments to be fixed, established and collected from time to time as hereinafter <br />provided. <br /> <br />c) The annual and special assessments, together with such interest thereon and costs of <br />collection thereof, as hereinafter provided, shall be a charge on the Lot and shall be a continuing lien <br />on the Lot against which each such assessment is made. Each such assessment together with such <br />interest, costs and reasonable attorney's fees shall also be the personal obligation of each Lot Owner <br />at the time when the assessment fell due. <br /> <br />2. Purpose of Assessments. The assessments levied and collected by the Association shall <br />be used as follows: <br /> <br />a) mowing grass, lawn care and snow removal for each Lot and the Common Area, and <br /> <br />b) repair, replacement or maintenance of the private drive, Via Milano, located on <br />Outlot B, and <br /> <br />c) taxes, insurance, landscaping, maintenance contracts, expenses of enforcing this <br />Declaration, and other charges for the Common Area, including the establishment and <br />maintenance of reserves. <br /> <br />7 <br />
