200506707 <br />maintenance and repair of the limited common elements (except for the structural parts of <br />the limited common elements) to which he has the right of exclusive use pursuant to <br />Section 2.6 of this Declaration. Each owner shall take all necessary action to keep the <br />limited common elements free and clean from unsightly accumulations of weeds, trash <br />and litter. Each owner shall have an easement over, across and through such portions of <br />common elements as are necessary in order for the owner to perform his obligations <br />under this Section with respect to the maintenance, repair, replacement and restoration of <br />those portions of the common elements and limited common elements which he is <br />obligated to maintain. <br />5.2 Repair or Restoration Necessitated by Owner. Each owner shall be liable to <br />the Association to the extent provided for by Nebraska law, for any damage to the <br />common elements or the improvements, landscaping or equipment thereon which results <br />from the negligence or willful conduct of the owner or the owner's family, employees, <br />guests and invitees. The cost to the Association of any such repair, maintenance or <br />replacements required by such act of an owner or the members of his family, guests or <br />invitees, shall be paid for by said owner, upon demand, to the Association. The <br />Association may enforce collection of such amounts in the same manner and to the same <br />extent as provided for in this Declaration for the collection of assessments. <br />5.3 Association's Right of Access. Each owner hereby grants to the Association <br />a right of access to the cornmon elements for the purpose of enabling the Association to <br />exercise and discharge its powers, duties and responsibilities under this Declaration. This <br />right of access shall include, without limitation, the right to enter upon the common <br />elements for the purpose of determining whether the provisions of this Declaration are <br />being complied with by the unit owners, family members, guests and invitees, tenants and <br />licensees. The Association shall have the right to enter a unit in case of emergency. <br />ARTICLE VI. <br />THE ASSOCIATION <br />6.0 Rigs ts,_Powers,_and Duties of the Association. The Association shall be an <br />unincorporated association, and shall have such rights, powers and duties as are <br />prescribed by the Condominium Act and as are set forth in this Declaration, together with <br />such further rights, powers and duties as inay be reasonably necessary to effectuate the <br />objectives and purposes of the Association as set forth herein. <br />6.1 Directors and Officers. The affairs of the Association shall be conducted by <br />an Executive Board and such officers and committees as the Directors may elect and <br />appoint, in accordance with this Declaration and the By -Laws. <br />6.2 Association Rules. By a majority vote of the Executive Board, the <br />Association may, from time to time and subject to the provisions of this Declaration, <br />adopt, amend and repeal rules and regulations. The Association Rules, may, among other <br />things, restrict and govern the use of any area by any owner, by the family of such owner, <br />-10- <br />
