20050670'7 <br />4. 10 Nuisances and Offensive Activity. No nuisances shall be permitted to exist <br />or operate upon the condominium and no activity shall be conducted upon the <br />condominium which is offensive or detrimental to any portion of the condominium or <br />any owner or occupants of the condominium. No exterior speakers, horns, whistles, bells <br />or other sound devise except security and emergencies devices used exclusively for <br />security or emergency purposes shall be located, used or placed on the condominium. <br />4.11 Window Coverings. No reflective materials, including, without limitation, <br />aluminum foil, reflective screens or glass, mirrors or similar type items shall be installed <br />or placed upon the outside or inside of any windows of a unit without the prior written <br />approval of the Association. No enclosures, blinds, shades, screens or other items <br />affecting the exterior appearance of a unit or any limited common elements reserved for <br />the use of such unit shall be constructed or installed in any unit or limited elements <br />without prior written consent of the Association. <br />ARTICLE V. <br />MAINTENANCE AND REPAIR OF COMMON ELEMENTS AND UNITS <br />5.0 Duties of the Association. The Association shall maintain, repair and make <br />necessary improvements to all common elements, except for those portions of the <br />common elements which the owners of the units are obligated to maintain pursualit to <br />section 5.1 of this Declaration. The portion of the common element that the Association <br />shall maintain includes, without limitation, all common facilities and improvements, <br />landscaping, drainage facilities, roadways, streets, parking areas and sidewalks. The <br />Association's duties for maintenance and repair of the common elements shall include the <br />exterior portion of the units and building, the land upon which the building is located, the <br />space above the building, all bearing walls, column, floors, roof, slabs, l:oundations, water <br />and sewer pipes, ducts, conduits, wires and all other utility installations of the building, <br />except for the outlets thereof when located within Units, and all structural parts of the <br />common elements. All such repairs and maintenance shall be common expenses and <br />shall be paid for by the Association. <br />5.1 Duties of Owners. Each owner of a unit shall maintain, repair, replace and <br />restore, at his own expense, all portions of his unit, subject to tlae Declaration and rules <br />and regulations of the Association. Each owner shall, at his own expense, maintain, <br />repair, replace and restore all doors, window glass, and any heating, cooling and air <br />conditioning systems and equipment exclusively serving his unit, and all electrical and <br />Plumbing fixtures and appliances exclusively serving his unit, including, without <br />limitation, laundry equipment, water heaters and other built -in appliances. Each owner <br />shall clean, maintain, repair, replace and restore all interior finishes, including, without <br />limitation, floor coverings and wall coverings. No owner shall remove, alter, injure or <br />interfere in any way with any shrubs, trees, grass or plantings placed upon the <br />condominium by the Declarant or the Association without first having obtained the <br />written consent of the Association. In addition, each owner shall be responsible for the <br />-9- <br />
