200503312 <br />9. Vegetation. <br />a. The owner of each lot shall keep the lawns and grass thereon cut to a height less than <br />five inches. <br />b. Prior to construction, an owner shall mow or cut all weeds and grass on their lot and <br />keep the vegetation to a height less than eight inches, if the owner should fail to maintain the lot <br />or keep the vegetation cut to a height of less than eight inches, then the Declarant, or the Board of <br />Directors may mow the lot and levy a special assessment and lien against the property and its <br />owner. <br />c. Lot owners desiring garden plots shall not cover or brace plants with plastic jugs, cans, <br />plastic bags or other unsightly materials. At the end of the growing season, garden plots are to be <br />cleared of all decaying foliage and all garden equipment is to be stored out of sight. Areas <br />devoted to vegetable gardens shall not exceed an area in size that is larger, longer, or wider than <br />fifteen feet (15) by fifteen (15) feet. No vegetable gardens shall be located in the front or the side <br />yards of homes. <br />10. kd& <br />a. No barns, chicken houses, or other buildings for the care and housing of fowl, <br />rabbits, pet pigs, or livestock shall be placed, maintained or used on any lot, nor shall any fowl, <br />rabbits, pet pigs, or livestock be kept upon any lot. The breeding of animals or keeping of animals <br />for any commercial purposes is not allowed. Pets such as dogs or cats are permitted, but shall be <br />kept restrained, and not be allowed to roam within the subdivision. <br />b. No more than two dogs per household shall be permitted, unless written <br />permission is obtained from the Board of Directors. <br />C. Each homeowner shall abide by all ordinances and regulations promulgated by the <br />Village of Doniphan regarding pets, including, but not limited to, the licensing, neutering, and <br />confinement of animals. <br />d. Plans and specifications for the construction and placement of all dog kennels shall <br />first be reviewed by the Declarant, the Board of Directors, or its designated committee. <br />e. Homeowners shall not leave dogs prone to excessive barking outdoors. <br />Homeowners may be fined up to $100.00 per week by the Board of Directors for failure to <br />confine their dog, or for failure to curtail incessant barking by their dog. All fines levied and <br />collected shall be paid to the Association treasury. <br />E Homeowners shall not allow their pets to defecate or urinate on neighboring lots. <br />Designated outlets or common areas within the subdivision may be used for pet exercise. Each <br />pet's owner shall be held strictly accountable and responsible for any failure to clean up pet feces <br />left in common areas or neighboring lots. Failure to abide by this provision may result in a fine of <br />up to $100.00 per incident by the Board of Directors. <br />11. Vehicles, Campers, _Bo t�s. <br />a. No campers, trailers of any kind, motor or mobile homes, boats, recreational <br />vehicles, or trucks larger than a one (1) ton pickup truck shall be stored on any lot, driveway, or <br />on the street in front of or on the side of any lot. However, homeowners, or their guests, may <br />park such vehicles in driveways for the purpose of loading, unloading, cleaning, or servicing such <br />vehicles or boats for a period of time not to exceed one week. <br />Page 8. <br />
