200503812 <br />5. &ffiack Requirements. Unless written approval from the Board of Directors, or its <br />designated Architectural Committee is obtained prior to construction, all buildings shall be placed <br />on the lot in accordance with the following setback requirements: <br />a. All measurements shall be computed from the foundation of the structure to the <br />nearest property line. <br />b. Minimum front yard setback of thirty (25) feet. <br />C. Minimum rear yard setback of thirty (25) feet. The rear setback shall apply <br />only to dwelling structures. <br />d. Minimum side yard setback of ten (10) feet. <br />e. Corner lots shall have a minimum setback adjacent to the side street equal to fifty <br />percent (50 %) of the required front yard. <br />E Driveways may be built within the setbacks as approved by the Board of <br />Directors or its designated committee. <br />6. :lujlding Codes. <br />a. All construction and building shall be so performed that it will comply with the <br />requirements of the building codes and ordinances of the Village of Doniphan, Hall County, and <br />the State of Nebraska. <br />b. No private wells, septic systems or cesspools shall be constructed or maintained or <br />allowed to remain on any part of the subdivision, and all dwellings erected on said lots shall be <br />serviced by a public sewer and water system provided by the Village of Doniphan. <br />7, wilding Requirements: Area Requirements: Garages. <br />a. Residential lots shall have no more than one (1) dwelling thereon, unless such lot <br />or combination of lots has been designated for multiple - family use, townhouses, or condominiums <br />by the Declarants. Each dwelling shall have a minimum of fifteen hundred (1,500) square feet <br />which shall include all space within the dwelling, but not include the square footage of the garage, <br />open porches, or basements. <br />b. Each residence shall a garage large enough for at least two, but not more than <br />three vehicles. At least one stall within the garage shall be large enough to accommodate an <br />extended cab pickup or utility vehicle, or at a minimum, not less than twenty (20) feet in length. <br />8. Sidewalks: Size; Location; Maintenance. <br />a. Upon completion of the owner's dwelling, it shall be the responsibility of the <br />homeowner to install sidewalks parallel to all streets abutting the property. Sidewalks shall be of <br />a uniform width (48 inches) and thickness (not less than 4 inches). Scoring shall occur every four <br />feet. <br />b. All sidewalks, unless approved otherwise by the Board of Directors, or its <br />designated committee, shall be placed ten feet back from the street curb within the dedicated <br />street right -of -way. <br />c. It shall be the responsibility of the homeowner the maintain all sidewalks, including the <br />clearing of snow and ice, and the replacement of cracked, heaving, or broken sidewalks. <br />Page 7. <br />
