Prior to the start of construction on any dwelling, and during the entire <br />construction period, the homeowner or the contractor shall maintain a trash dumpster on the lot <br />for the disposal of trash, debris, and waste materials. The dumpster shall be emptied as needed <br />and not allowed to overflow. During the time of construction, the owner shall be responsible for <br />keeping the lot clean, and removing all trash, debris, and waste material which may blow from the <br />lot. Failure of the owner to abide by this provision may result in one or more fines or special <br />assessments to be paid to the Association treasury. <br />j. Construction of a dwelling shall begin not later than two years after the initial <br />purchase of a lot from the Declarant. The Board of Directors may, at its discretion, impose a <br />special assessment payable to the Association treasury up to, but not in excess of $1,000.00 per <br />year, on each lot and its owner that is not in compliance with this provision. <br />k. Once construction on a dwelling unit that has been approved by the Declarant, the <br />Board, or its designated committee begins, the homeowners or contractors shall complete all <br />construction on the dwelling within twelve (12) months from start of construction. Construction <br />shall be deemed to have started when the ground has been dug for the footings and foundation of <br />the dwelling or structure. For projects other than a dwelling, shorter time limits for the <br />completion of its construction may be imposed by the Declarant, the Board, or its designated <br />committee. <br />1. Final grading of the lot shall occur as soon as possible following completion of the <br />dwelling to provide for adequate drainage from the lot and to prevent any ponding on adjacent <br />and /or contiguous lots. At no time shall the grading, or a lack of grading on any lot, cause the <br />ponding of water on adjacent and/or contiguous lots. All homeowners shall abide by a master <br />surface drainage plan, and any amendments or alterations thereto, which may be prepared by the <br />Declarant and the Association Board. <br />M. All landscaping, including the installation of sidewalks, must be done in a <br />professional manner and completed not later than nine months following the completion of the <br />dwelling. <br />n. Upon completion of the dwelling, the lot shall be cleared of all construction <br />materials, brick piles, and other debris. <br />o. All homeowners shall include an improved paved driveway from the garage to the <br />street adjacent to the property. All driveways shall be wide enough to accommodate at least two <br />(2), but not more than three (3) vehicles parked side -by -side. All driveways shall be long enough <br />to prevent vehicles from blocking or obstructing sidewalks. <br />P. All privacy fences and enclosures shall be approved by the Board of Directors or <br />its designated committee before being erected. <br />q. The Declarant, the Board of Directors, or its designated committee, shall compile a <br />list of rules for the homeowner and the contracting builders, which shall be signed and made a <br />part of its approval in writing between the Board, or its designated committee, and the <br />homeowner. As needed, the Declarant, the Board of Directors, or its designated committee, may <br />alter, amend, or impose additional construction rules that it may deem necessary to address any <br />problems unforeseen at the time of approval. <br />r. No earth shall be removed to the injury of the value or appearance of any lot, nor <br />for commercial purposes, unless approved by the Board of Directors, or its designated committee. <br />Any change in the elevation of a lot must be approved by the Board of Directors or its designated <br />committee. <br />S. A minimum amount of vertical exterior brick shall be required on not less than <br />twenty -five percent (25 %) of the front of each dwelling, unless otherwise agreed to by the <br />Declarant, the Board, or its designated committee.
