<br />4. That Dora Denman, spouse of Arthur C. Denman, died May
<br />23, 1960, in Grand Island, Nebraska, and her estate was
<br />administered in the County Court of Hall County, Nebraska, Case No.
<br />38 -63, and that her life estate in and to the two above - described
<br />properties terminated on her death.
<br />5. That the second life tenant Alvin Denman, son of Arthur
<br />C. ;Denman, died on August 16, 1992, and his estate was administered
<br />as Case No. PR92 -96 in the County Court of Hall County, Nebraska,
<br />and that the determination of heirs in his estate proceedings
<br />determined that the said deceased left surviving his spouse, Shiron
<br />Denman, and three children, Danny D. Denman, son; Douglas A.
<br />Denman, son; and Diana J. Nielsen, daughter, being his sole and
<br />only children.
<br />6. That the said Dorothy J. Lepp, daughter of Arthur C.
<br />Denman, and the second life tenant in the real estate described in
<br />Paragraph 3 above, died at Grand Island, Nebraska on October 28,
<br />2001, preceded in death by her spouse, her father, mother, and
<br />brother, Alvin Denman, and leaving no child or children or issue of
<br />the same surviving her, and that attached hereto, marked Exhibit
<br />"A" and made a part hereof, is a true and exact copy of the
<br />Application for Informal Probate of Will and Codicil and
<br />Registrar's Statement of Informal Probate in the Estate of Dorothy
<br />J. Lepp, Estate No. PRO1 -210, in the County Court of Hall County,
<br />Nebraska.
<br />7. That upon the death of the last life tenant, Alvin
<br />Denman, the property described as the Southeast Quarter (SE1 /4) and
<br />the south Half of the Northeast Quarter (S1 12 NE1 /4), both Section
<br />Thirty -One (31) , Township Eleven (11) North, Range Ten (10) West of
<br />the 6th P.M., Hall County, Nebraska, passed and descended pursuant
<br />to the Last Will and Testament of Arthur C. Denman, to the sole and
<br />only children of Alvin Denman, namely, Danny D. Denman, Douglas A.
<br />Denman, and Diana J. Nielsen, in equal shares to each.
<br />8. That upon the death of the last life tenant, Dorothy
<br />Lepp, the property described as the Northwest Quarter (NW1 /4) and
<br />the West Half of the Northeast Quarter (W1 /2 NE1 /4), both Section
<br />Thirty -One (31), Township Eleven (11) North, Range Eleven (11) West
<br />of the 6th P.M., Hall County, Nebraska, passed and descended
<br />pursuant to the Last Will and Testament of Arthur C. Denman, to the
<br />sole and only children of Dorothy Lepp's brother, Alvin Denman,
<br />namely, Danny D. Denman, Douglas A. Denman, and Diana J. Nielsen,
<br />in equal shares to each.
<br />9. That the said Danny D. Denman, sometimes known as Danny
<br />Denman; Douglas A. Denman, sometimes known as Douglas Denman; and
<br />Diana J. Nielsen, sometimes known as Diana Nielsen, are the present
<br />record owners of the two properties described in Paragraphs 2 and
<br />3 above, they being the remaindermen designated by the terms of the
<br />Last Will and Testament of Arthur C. Denman, deceased.
