<br />B. J. CUNNINGHAM, JR., being first duly sworn on oath, deposes
<br />and states as follows:
<br />1. That Affiant has practiced law in Hall County, Nebraska,
<br />for more than 50 years, and was well and personally acquainted with
<br />Arthur C. Denman, who died April 16, 1967; with his spouse, Dora
<br />Denman, who died May 23, 1980; with their son, Alvin Denman, who
<br />died August 16, 1992; and with their daughter, Dorothy J. Lepp, who
<br />died October 28, 2001, and that Affiant handled the probate
<br />administration of the estates of each of said four named persons.
<br />2. That by the terms and provisions of Arthur C. Denman's
<br />Last Will and Testament and the Final Decree entered therein by the
<br />County Court of Hall County, Nebraska, in Case No. 7164, said
<br />Decedent devised the following described property:
<br />The Southeast Quarter (SE1 /4) and the South Half of the
<br />Northeast Quarter (S1 /2 NE1 /4), both Section Thirty -One
<br />(31), Township Eleven (11) North, Range Ten (10) West of
<br />the 6th P.M., Hall County, Nebraska,
<br />to his spouse, Dora Denman, for the period of her life, then to
<br />Alvin Denman, son, for the period of his life, and the remainder to
<br />such of the Decedent's grandchildren (by both son, Alvin Denman,
<br />and daughter, Dorothy Lepp) as are then living.
<br />3. That by the terms and provisions of Arthur C. Denman's
<br />Last Will and Testament and the Final Decree entered therein by the
<br />County Court of Hall County, Nebraska, in Case No 7164, said
<br />Decedent devised the following described property:
