200204993 (4), and to a point of curvature; thence running southwesterly along the easterly line of said Lot Four (4), and the arc of a curve to the right whose radius is One Hundred (100.0) feet, the long chord of which bears S2203 1'56"W, a long chord distance of Seventy Six and Seventy Eight Hundredths (76.78) feet; thence running S45 °07'18 "W, along the southeasterly line of said Lots One (1) and Four (4), a distance of Three Hundred Eighty Two and Seventy Six Hundredths (382.76) feet, to the southeast corner of said Lot One (1); thence running S89 °43'36 "W, along the south line of said Lot One (1), a distance of Two Hundred Ninety Seven and Three Tenths (297.30) feet; thence running N88 °50'15 "W, and continuing along the south line of said Lot One (1), a distance of Four Hundred and Five Hundredths (400.05) feet, to the point of beginning and containing 17.246 acres more or less; desires to have subdivided as a subdivision the foregoing tract of land located within the corporate limits of the City of Grand Island, Nebraska, and hereby submits to the City Council of such City for acceptance as provided by law an accurate map and plat of such proposed subdivision, to be known as THE VILLAGE THIRD SUBDIVISION, designating explicitly the land to be laid out and particularly describing the lots, easements, and streets belonging to such subdivision, with the lots designated by number, easements by dimensions, and streets by name, and proposes to cause the plat of such subdivision when finally approved by the Regional Planning Commission and the City Council to be acknowledged by such owner, certified as to accuracy of survey by a registered land surveyor, and to contain a dedication of the easements to the use and benefit of public utilities, and of the street to the use of the public forever. In consideration of the acceptance of the plat of said THE VILLAGE THIRD SUBDIVISION, the Subdivider hereby consents and agrees with the City of Grand Island, Nebraska, that it will install or provide at its expense the following improvements: Residential Development. The proposed development constitutes a planned unit development pursuant to Section 36 -39 of the Grand Island City Code. For that reason, the Subdivider agrees that the continuing requirements of Section 36 -69 of the Grand Island City Code -2-
