200204993 <br />pertaining to residential development under the Planned Unit Development, will be complied with by <br />the developer. The Subdivider also agrees to develop and landscape the property in accordance with <br />the proposed Building Elevations and Development Master Plan for The Village Third Subdivision, <br />approved by the City Council on March 26, 2002. <br />2. Paving. The Subdivider agrees to waive the right to object to the creation of <br />any paving or repaving district for Ramada Road and Woodland Drive where they abut the <br />subdivision. The Subdivider agrees to pave all private roads, including installation of sidewalks, as <br />shown on the RD Development Master Plan approved for this subdivision. <br />3. Water. The Subdivider agrees to petition the City for creation of a public <br />water main district to extend, connect and provide water service to the subdivision, and to pay all <br />special assessments levied in connection with said district. The Subdivider agrees to hire a <br />professional engineer to prepare construction plans and specifications, and to provide construction <br />staking and inspection services, to certify all work has been done in accordance with plans and <br />specifications approved by the Director of Utilities. The City Utilities Department will advertise the <br />work for bids, administer the contract, make all contractor payments, and prepare the special <br />assessment schedule. The city Utilities Department shall be paid four percent (4 %) of the total <br />contract amount for providing their services. <br />4. Sanitary Sewer. The Subdivider agrees to petition the City for creation of a <br />sanitary sewer district to extend, connect and provide sanitary sewer service to the subdivision, and <br />to pay all special assessments levied in connection with said district. The Subdivider agrees to hire a <br />professional engineer to prepare construction plans and specifications, and to provide construction <br />staking and inspection services, to certify all work has been done in accordance with plans and <br />-3- <br />
