200201299 92- -IV- ')951.9 <br />6. TAXES AND ASSESSMENTS. As additional rental under this <br />lease, TENANT shall pay and discharge as they become due, <br />promptly and before delinquency all taxes and assessments <br />levied and assessed against the lease premises of every name, <br />nature and'kind whatsoever including all governmental charges <br />of whatsoever nature, name or kind, which may be levied, <br />assessed charged or imposed or which may become a lien or <br />charge on or against the premises or any part of the premises, <br />any building or buildings or any other improvements constructed <br />on the premises or on or against the TENANT'S estate created by <br />this Lease that may be subject to taxation for on or against <br />LANDLORD by reason of LANDLORD'S ownership of the fee <br />underlined the Lease during the entire term of this lease. <br />7. CONSTRUCTION OF BUILDINGS OR IMPROVEMENTS ON THE PREMISES. <br />TENANT is permitted to construct buildings or other <br />improvements on the premises during the term of the Lease. If <br />TENANT or any assignee of this Lease constructs any buildings <br />or improvements on the premises all repairs and maintenance of <br />the buildings and improvements must be made by TENANT and <br />LANDLORD has no liability or obligation whatsoever for repair <br />or maintenance of any such buildings or improvements <br />constructed on the premises. <br />8. UTILITIES. TENANT will pay for all utilities used on or in <br />the premises commencing July 1, 1992. <br />9. ASSIGNMENT. TENANT may assign this Lease without the prior <br />consent of LANDLORD and this Lease may be assigned and <br />reassigned without consent of LANDLORD. All assignees of this <br />Lease have all of the rights of the TENANT under this Lease. <br />10. LANDLORD HELD HARMLESS. TENANT will hold LANDLORD harmless <br />from all injuries and damages incurred by TENANT or anyone else <br />and for all losses and expenses incurred by LANDLORD caused by <br />TENANT occupying the premises. <br />11. LANDLORD'S LIABILITY EXONERATED. LANDLORD'S liability to <br />TENANT for injury or damage, however caused, to any property or <br />person on the premises is exonerated by TENANT. TENANT waives <br />all right of recovery from LANDLORD for injury or damage <br />covered by insurance carried by TENANT. <br />12. ALTERATIONS AND ADDITIONS. Alterations and additions may <br />be made to the premises by TENANT without obtaining any prior <br />consent from LANDLORD. <br />13. DUTIES OF TENANT. TENANT will obey all laws and ordinances <br />controlling the use and occupancy of the premises by TENANT. <br />14. VACATION OF PREMISES. Upon the termination of this Lease, <br />TENANT must vacate the premises and return possession to <br />LANDLORD in a clean condition and in good repair, reasonable <br />wear and tear excepted. <br />
