200405934 <br />10.3 Limitations on Trade Contractor With Respect to Claims for Extensions of Time or Damages: In no <br />event shall Trade Contractor be entitled to any extension of time or any damages for any delays, <br />disruptions or interference's caused or contributed to in any way by Trade Contractor. <br />SECTION 11 <br />Cleaning <br />11.1 Trade Contractor's Duty to Clean Up: Trade Contractor, daily, shall clean and remove from the Project <br />and lawfully dispose of any dirt, surplus materials, obstructions, hindrances or debris resulting from Trade <br />Contractor's Work. With respect to the disposal of Regulated Substances (as defined hereafter), Trade <br />Contractor strictly shall comply with the requirements of Section 17.2. Upon completion of its Work, <br />Trade Contractor shall clean, wash, remove protective coatings and leave its Work in such cleaned <br />condition as this Trade Contract and the Contract Documents require and shall remove all of its remaining <br />debris, equipment and temporary facilities from the Project. <br />11.2 SIGNATURE's Rights if Trade Contractor Does Not Adequately Clean: If Trade Contractor fails to <br />comply with Section 11. 1, SIGNATURE may provide such clean up work on behalf of Trade Contractor <br />and charge Trade Contractor for the costs thereof, plus ten percent (10 %) for overhead and ten percent <br />(10%,o) for profit. SIGNATURE may provide such clean up during evening, night and weekend hours, in <br />which case any shift differential or overtime wage premiums will be included in the charges assessed <br />against Trade Contractor. In addition, and having given twenty-four hours notice, SIGNATURE shall have <br />the right to stop Trade Contractor's Work until clean up is achieved. SIGNATURE may deduct such clean <br />up charges from any payment due Trade Contractor. <br />SECTION 12 <br />Changes to the Work <br />12.1 SIGNATURE May Order Changes: Without invalidating this Trade Contract or any bond given <br />hereunder, SIGNATURE may order additions, deletions or other modifications to Trade Contractor's <br />Work, without notice to any surety. Adjustments to the Trade Contract Price, if any, shall be made in <br />accordance with the provisions of the Contract Documents and this Trade Contract. <br />12.2 Review of Change Requests: Upon receipt of a request to change the Work issued by the Owner, the <br />Architect or by SIGNATURE, Trade Contractor shall review each such request and provide to <br />SIGNATURE, in writing, within the time and in such detail requested by SIGNATURE, but in no event <br />later than ten (10) days from receipt of the request, a specific analysis as to the impact, if any, on Trade <br />Contractor's Work, including any adjustment to the Trade Contract Price or Contract time. <br />12.3 Price and Time Changes Valid Only by Written Change Order: The Trade Contract Price and time for <br />completion will not be changed except upon written Change Order from SIGNATURE. Changes in the <br />Trade Contract Price shall not be included in Trade Contractor's payment applications until a written <br />Change Order has been fully executed by SIGNATURE and Owner incorporating the price change into the <br />Trade Contract Price. <br />12.4 No Claim for Lost Profit: If any change reduces the quantity of Trade Contractor's Work, Trade <br />Contractor shall not make any claim for loss of anticipated profit. <br />12.5 Dispute as to Price: If, with respect to any change in Trade Contractor's Work, SIGNATURE and Trade <br />Contractor cannot agree upon an adjustment to the Trade Contract Price or time for completion, <br />SIGNATURE may order Trade Contractor to proceed with the change in accordance with SIGNATURE's <br />instructions and Trade Contractor shall so proceed to carry out the changed Work and shall record the cost <br />of the changed work as required by the Contract Documents or as ordered by SIGNATURE. Any claim for <br />additional compensation or additional time shall be processed in accordance with Section 10. If Trade <br />Contractor contests the time of completion provided for any change, it must file a claim for an extension of <br />time pursuant to the provisions of Section 10 or it will waive its right to contest the time for completion <br />provided for the change. <br />Initial 72LI/ <br />12 <br />
