This Deed of Trust, the Note, and any other instrument given to evidence or further secure the payment and performance of any obligation secured hereby are referred to collectively as the "Loan Instruments" . TO PROTECT THE SECURITY OF THIS DEED OF TRUST: l . PAYMENT OF INDEBTEDNESS . Trustor shall pay when due the principal of, and the interest on, the indebtedness evidenced by the Note . 2 . TAXES . Trustor shall pay each instal_lment of all taxes and special asse�sments of every kind, now or hereafter levied against the Trust Estate or any part thereof. Trustor shall pay all taxes and assessments which may be levied upon Beneficiary' s interest herein or upon this Deed of Trust or the debt secured hereby, without regard to any law that may be enacted imposing payment of the whole or any part thereof upon the Beneficiary. 3. INSURANCE AND REPAIRS. Trustor shall maintain fire and extended coverage insurance insuring the dwelling of the Trustor at 800 of the replacement value of the dwelling. Such insurance policy shall not be cancelable, terminable or modifiable without 10 days prior written notice to Beneficiary. Trustee shall cause evidence of such insurance to be delivered to Beneficiary. Trustor shall repair, maintain and replace the dwelling or any part thereof so that, except for ordinary wear and tear, the dwelling shall not deteriorate . In no event shall the Trustor commit waste on or to the dwelling or real property. 4 . CONDEMNATION. The proceeds of any award or claim for damages, dir.ect or consequential, in connection with condemnation less than 500 of the total acres owned by Trustor or other taking of any part of the Property, or for conveyance in lieu of condemnation, are hereby assigned and shall be paid to Trustor. In the event of a total taking or taking in excess of said 500, of the property, the proceeds are hereby assigned to Beneficiary and the proceeds shall be applied to the sums secured by this Security Instrument, whether or not then due, with any excess paid to Trustor. If the Property is abandoned by Trustor, or if, after notice by Beneficiary to Trustor that the condemnor offers to make an award or settle a claim for damages, Trustor fails to respond to Beneficiary within thirty (30) days after the date the notice is given, Beneficiary is authorized to collect and apply the proceeds, at its option, either to restoration or repair of the Property or to the sums secured by this Security Instrument, whether or not then due .
