<br /> THIS DEED OF TRUST, is made as of the 12th day of December, 1999, by �
<br /> and among Vernon R. Bauer, ("Trustor") , whose mailing address is
<br /> 3881 North U. S . Highway 281, Grand Island, Nebraska 68803 and Doug
<br /> Pauley, attorney at law, ( "Trustee" ) , whose mailing address is P. O.
<br /> Box 315, Hastings, Nebraska, 68902, and Dorothy L. Bauer,
<br /> ("Beneficiary") , whose mailing address is 514 Lane G, Hastings,
<br /> Nebraska 68901 .
<br /> FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers, conveys
<br /> and assigns to Trustee, IN TRUST, WITH POWER OF SALE, for the �
<br /> benefit and security of Beneficiary, under and subject to the terms
<br /> and conditions of th.is Deed of T.rust, the real property, located in
<br /> the County of Hall, atate oi i�lebraska, and described as follows (the
<br /> "Property") :
<br /> The Northwest Quarter (NW1/4 ) of Section Thirty-three
<br /> (33) , Township Twelve (12) , Range Nine (9) , in Hall
<br /> County, Nebraska, excepting therefrom that portion
<br /> conveyed to the State of Nebraska by Warranty Deed dated
<br /> April 26, 1937 and recorded in the Register of Deeds
<br /> office of Hall County, Nebraska, in Deed Book 77, at page
<br /> 92 ; and also excepting that portion deeded to Donald W.
<br /> Haggart and Evelyn C. Haggart, said deed dated September
<br /> 8, 1967 and recorded in the Register of Deeds office of
<br /> Hall County, Nebraska, in Deed Book 154 , at page 537 .
<br /> TOGETHER WITH, all easements, appurtenances, hereditaments,
<br /> interests in adjoining roads, streets and alleys and the personal
<br /> residence of Trustor.
<br /> The Property and the estate and interest conveyed to the Trustee are
<br /> referred to collectively as the "Trust Estate" .
<br /> THIS DEED OF TRUST IS FOR THE PURPOSE OF SECURING:
<br /> A. Payment of indebtedness in the total principal amount of
<br /> $200, 000 . 00, with interest thereon, as evidenced by that certain
<br /> promissory note of even date (the "Note") with a maturity date of
<br /> December 12, 2004, executed by Trustor, which has been delivered and
<br /> is payable to the order of Beneficiary, and which by this reference
<br /> is hereby made a part hereof, and any and all modifications,
<br /> extensions and renewals thereof, and
<br /> B. Payment of all sums advanced by Beneficiary to protect the Trust
<br /> Estate, with interest thereon at the rate of 5 . 966 percent per
<br /> annum. Payments shall begin December 12, 1999, in the sum of
