9 a7 1�6 �2�' AGREEMENT FOR PURCHASE OF REAL PROPERTY <br /> . BY AND BETWEEN <br /> TT�COUNTY OF HALL AND'THE CITY OF GRAND ISLAND <br /> 9 Occupancy. The County, upon closing, shall exclusively occupy and control the <br /> office area of the Property, hereinafter referred to �,s Area "A," as illustrated on <br /> Exhibit "A" attached hereto, and the employee parking area as illustrated on <br /> Exhibit B attached hereto. The City, upon closing, shall exclusively occupy and <br /> control the warehouse area, hereinafter referred to as Area "B," as illustrated on <br /> Exhibit A, and the following areas illustrated on Exhibit "B": the west storage <br /> yard, loading area, and east storage yard. Notwithstanding such exclusive <br /> occupancy, the parties sha11 possess and retain reasonable right of access to the <br /> entire Property as necessary for access to utilities, building remodeling, <br /> maintenance and repairs, and other similar purposes. The Parties shall not <br /> unreasonably withhold such rights of access by the other. <br /> 10 Utilities and Services. Each area shall be separately metered for gas and <br /> electricity. Parties to equally divide and share costs of such work. Sewer and <br /> water bills to be equally shared between the City and the County. <br /> 11 Maintenance and Repairs. Each party shall keep their respective areas in good <br /> condition and state of repair, being individually responsible for all costs of repair <br /> and maintenance of said respective areas including, but not limited to, the building <br /> exterior and interior, HVAC (heating, ventilating, and air conditioning) systems, <br /> and utility systems, i.e. sewer, water, electrical, telephone, and other similar <br /> systems. City, at city's expense, shall be responsible for maintenance of the <br /> grounds including, but not limited to, lawn care, tree maintenance, and snow <br /> removal. The parties shall equally share the cost and expense of maintaining sewer <br /> and water services, connection fees and usage charges. Additionally, the parties <br /> shall equally share the cost and expense of maintaining common partition walls and <br /> common structural elements. <br /> Page 5 <br />
