g� 1'�6 �2� AGREEMENT FOR PURCHASE OF REAL PROPERTY <br /> • BY AND BETWEEN <br /> . TI�COUNTY OF HALL AND TI�CIT'Y OF GRAND ISLAND <br /> claims, litigation, administrative proceedings, are pending or threatened, and no <br /> judgments or orders have been entered relating to any hazardous substance, <br /> hazardous waste, discharge, emission or other form of pollution relating in any <br /> way to the Property. No hazardous substance or hazardous waste, as defined by <br /> the Resource Conservation Recovery Act, as amended, 42 U.S.C. section 6901 et <br /> seq., or the Comprehensive Environmental Response, Compensation and Liability <br /> Act, as amended, 42 U.S.C. section 9601 et seq., has been generated, <br /> manufactured, refined, transported, treated, stored, handled or disposed of on, at <br /> or near the Property. Neither party shall generate, manufacture, refine, transport, <br /> treat, store, handle, or dispose of any hazardous substance or hazardous waste on <br /> the Property without written consent of the other party which consent shall not be <br /> unreasonably withheld. Provided, however, nothing contained herein is intended <br /> to nor shall be construed as prohibiting the storage or handling of cleaning, <br /> maintenance and shop supplies; herbicides, insecticides, fertilizers and similar lawn <br /> and aquatic care substances; and chemicals, drugs and agents utilized in the day to <br /> day operation of a public health department and health department laboratory. <br /> 7 Taxes and Special Assessments. All taxes, if any, related to the Property shall be <br /> paid by City at or prior to closing. Any special assessment arising out any <br /> improvement completed or under construction prior to Closing, whether then <br /> levied or unlevied, assessed or unassessed, shall be borne by City. City shall pay <br /> any and all transfer taxes or similar fees which are payable upon the recording of <br /> the warranty deed from the City to the County. Any property taxes levied <br /> following closing shall'be paid by the parties in relation to the Property to which <br /> the taxes are attributable <br /> 8 Use and Zoning. The City warrants the County's intended use of the Property as a <br /> government office building complies with applicable zoning and city ordinances. <br /> Page 4 <br />
