202.405035 <br />In the event a party fails to pay any child, medical, or spousal support payment, as such <br />failure is certified each month by the State Disbursement Unit in cases in which court -ordered <br />support is delinquent in an amount equal to the support due and payable for a one -month period <br />of time, that party shall be subject to income withholding and may be required to appear in Court <br />on a date to be determined by the Court and show cause why such payment was not made. In the <br />event that such party fails to pay and appear as ordered, a warrant shall be issued for the arrest of <br />that party. <br />The parties are to alternate the tax exemptions with the Plaintiff receiving the 2018 <br />exemptions. If the Defendant is current in his child support obligation he will receive the tax <br />exemptions in odd -numbered years. <br />IV. SPOUSAL SUPPORT <br />The Court has considered the factors set forth in NEB. REV. STAT. §42-365 "including <br />contributions to the care and education of the children and interruption of personal careers or <br />educational opportunities; and the ability of the supported party to engage in gainful employment <br />without interfering with the interests of any minor children in the custody of such party." The <br />Court has further considered that: <br />While need is certainly a factor in analyzing alimony, it is only one of several <br />factors within our analysis. If we were to focus solely on the element of need, as <br />suggested by Katrina, we would be ignoring several of the other factors relevant <br />to an award of alimony...such factors include the relative economic <br />circumstances, the disparity in the parties' incomes and earning capacities, and <br />the general equities of the case. Becker v. Becker, 20 Neb. App. 922, 834 <br />N.W.2d 620 (2013) (citations omitted). <br />Since October 1, 2016, the Plaintiff has been awarded temporary support.
