202402567 <br />14. Waiver of Exemption Rights. NO OWNER MAY PROTEST PROPERTY TAX <br />VALUATIONS FOR ANY LOT REQUESTING A VALUATION LESS THAN ANY <br />MINIMUM VALUATION AS SET FORTH IN ANY REDEVELOPMENT CONTRACT FOR <br />ANY TAX INCREMENT FINANCING PROJECT, NOR CLAIM, OR IN ANY MANNER <br />UTILIZE, THE NEBRASKA HOMESTEAD EXEMPTION (OR ANY OTHER EXEMPTION <br />UNDER NEBRASKA OR FEDERAL LAW) TO EXCLUDE ANY LOT FROM THE <br />OBLIGATION TO PAY ANY AD VALOREM TAXES LEVIED UPONANY LOT FOR SO <br />LONG AS ANY PORTION OF SUCH AD VALOREM TAXES ATTRIBUTABLE TO THAT <br />LOT ARE ALLOCATED INTO A SPECIAL FUND OF THE COMMUNITY <br />REDEVELOPMENT AUTHORITY FOR THE PAYMENT OF PRINCIPAL, INTEREST, AND <br />OTHER ELIGIBLE COSTS RELATED TO THE PROPERTY FOR ANY OUTSTANDING <br />TAX INCREMENT FINANCING PROJECT; AND EACH OWNER SHALL BE DEEMED TO <br />HAVE IRREVOCABLY WAIVED ANY SUCH EXEMPTION. <br />ARTICLE III <br />ENFORCEMENT <br />1. Remedies for Violations. If the Owner of any Lot, or a family member of the Owner <br />or Owner, their heirs or assigns, violate any of the covenants, restrictions and conditions set forth <br />in the Declaration, it shall be lawful for any other Owner to enforce this Declaration in proceedings <br />at law or in equity against the person or persons violating or attempting to violate this Declaration. <br />The Developer and the Association may, but are not required, to enforce the Declaration. The <br />failure to promptly enforce any of the covenants, restrictions or conditions of the Declaration shall <br />not, in any way, be a waiver of their enforcement. <br />2. Covenant Declared Void. If any of the covenants, restrictions or conditions set <br />forth in the Declaration is declared void by a court of competent jurisdiction, the remaining <br />covenants, restrictions or conditions shall not be affected, but shall remain in full force and effect. <br />7 <br />
