202402567 <br />11. Building Codes. Notwithstanding this Declaration, all construction and building <br />shall be performed so that it will comply with the requirements of the building codes and <br />ordinances of Hall County, the City of Grand Island, Nebraska and State of Nebraska. <br />12. Building and Area Requirements. Each Dwelling, garage, outbuilding and chicken <br />coop on Lot shall have a roof constructed of shingles or other materials approved in writing by the <br />Developer. Each Single Family Lot shall have no more than one (1) Dwelling thereon and such <br />Dwelling shall meet the following minimum square feet requirements, which minimum square <br />footage shall not include garages and open porches. <br />a. Dwellings on Single Family Lots shall have a minimum of one thousand <br />(1,000) livable square feet on the first level, which shall be above ground. <br />b. Dwellings on any Multi Family Lots shall have a minimum of seven <br />hundred twenty (720) livable 'square feet per residential unit on the first level, <br />which shall be above ground. <br />c. The minimum liveable square footage of any split-level or split -foyer type <br />Dwelling shall be above ground level, and the finished sub -basement of the <br />Dwelling shall not be included in computing the minimum liveable square footage. <br />d. Construction of a Dwelling must commence within six (6) months of <br />purchase of a Lot and must be completed within one (1) year after date of <br />conveyance. In the event the commencement and completion of construction <br />deadlines have not been met, Developer, or its successor in interest, has the absolute <br />right to repurchase the Lot for the purchase price paid by the owner and shall exercise <br />this option by delivering written notice to the Owner of said Lot. Developer may in <br />its discretion waive or extend the foregoing deadlines. <br />13. Vegetation. The Owner of each Lot shall keep the vegetation and grass thereon in <br />an attractive and reasonable level which shall not be an eyesore. Prior to construction, an Owner <br />shall mow or cut all weeds and grass on their Lot. There shall be no cottonwood trees planted. <br />6 <br />
