202402567 <br />3. Persons Subject to Restrictions; Modifications. This Declaration will run with the <br />land and shall be binding upon all persons and all parties claiming ownership of Lots for a term of <br />ten (10) years from the date this Declaration is recorded, after which time it shall be automatically <br />extended for successive periods of ten (10) years unless amended or revoked. The Declaration <br />may be amended, or a variance granted by an instrument signed by the Developer, so long as it <br />owns at least one (1) Lot. Thereafter, Owners of more than fifty percent (50%) may amend the <br />Declaration or grant a variance. Revocation of the Declaration shall require approval of at least <br />seventy five percent (75%) of the Owners and by Developer so long as Developer owns at least <br />one (1) Lot. Any amendment or revocation of this Declaration shall be recorded with the Register <br />of Deeds of Hall County, Nebraska. <br />ARTICLE IV <br />ASSOCIATION FORMATION, OPERATION AND GENERAL REQUIREMENTS: <br />1. Every Owner of a Lot is automatically a member of the Association. Membership <br />in the Association is a condition of ownership of any Lot. No Lot Owner can <br />disclaim or renounce membership in the Association. Membership shall be <br />appurtenant to and may not be separated from ownership of any Lot which is <br />subject to assessment. The Association shall have one class of voting membership <br />which shall be and include the Owner of each Lot. When more than one (1) person <br />holds an interest in any Lot all such persons shall be members of the Association <br />but any vote for such Lot shall be exercised as they among themselves determine <br />with no more than one (1) vote being cast with respect to any Lot. All Lot owners <br />shall abide by the provisions of this Declaration, and the By -Laws of the <br />Association as may be amended from time to time. NOTWITHSTANDING THE <br />FOREGOING, THE DEVELOPER AND ITS SUCCESSOR SHALL CONTROL <br />THE OPERATION OF THE ASSOCIATION, SET ASSOCIATION BUDGETS, <br />REGULAR AND SPECIAL ASSESSMENTS DURING THE DEVELOPER <br />CONTROL PERIOD (INCLUDING ANY ADDITIONAL LOTS ADDED TO <br />THE PROPERTY) WHICH ARE SUBJECT TO THIS DECLARATION OF <br />RESTRICTIVE COVENANTS. THEREAFTER, THE ASSOCIATION SHALL <br />PERFORM THESE FUNCTIONS. <br />8 <br />
