202402567 <br />6. "Dwelling" shall mean any building or portion of a building situated upon a Lot <br />designed and intended for use and occupancy as a primary residence. <br />7. "Lot" shall mean any lot which is part of the Property, including but not limited to <br />Single Family Lots and Multi Family Lots. <br />8. "Multi Family Lots" shall mean Lots One (1) through Ten (10) inclusive, Highland <br />North First Subdivision and any additional multi family lots added as part of the Additional <br />Property. <br />9. "Owner" shall mean the record owner, whether one or more persons or entities of <br />a fee simple title to any Lot. Owner may include a person or persons or entities under a recorded <br />land contract or installment sale contract if the record owner executes a release and transfer of his <br />or her voting rights to the contract purchaser. Others having a lien or interest merely as security <br />for the performance of an obligation are not owners. The initial Owners are A & H Holdings, <br />L.L.C., and Alloway Holdings, L.L.C. <br />10. "Property" means all of the real estate included in this Declaration and any <br />Additional Property. <br />11. "Single Family Lots" shall mean Lots One (1) through Ten (10) inclusive, <br />Highland North Second Subdivision initially and any additional lots single family lots added as <br />part of the Additional Property. <br />ARTICLE II. <br />COVENANTS, RESTRICTIONS AND CONDITIONS <br />In consideration of the mutual benefits to be derived by the Owners and any purchaser or <br />purchasers, their heirs, devisees, personal representatives and assigns, any and all of the Lots in <br />the Property as surveyed and platted and more particularly described as recorded in the office of <br />the Register of Deeds, Hall County, Nebraska, that are sold, transferred and conveyed, shall be <br />and are subject to the following protective covenants, restrictions and conditions. All covenants, <br />restrictions and conditions shall run with the land and are as follows: <br />1. Lots Affected, Use of Lots. All Lots shall be known and described as residential <br />lots except Developer reserves the right to construct a community building, gardens, dog parks or <br />similar amenities on any Developer owned Lot.
