202402567 <br />permitted to remain on any residential lot other than one (1) Dwelling structure (which may include <br />1, 2, or 3 residential living units on the Multi Family Lots) with an attached or detached garage, <br />one (1) outbuilding and one (1) chicken coop, which must be complimentary to the design of the <br />house and be within city setback limits. All Single Family Lots must be owner occupied. At least <br />one unit in each Multi Family Lot must be owner occupied. Airbnb, VRBO or similar short term <br />occupancies are prohibited. Commercial or business enterprises are permitted on any Lot provided <br />such business complies with applicable zoning requirements and does not disturb other Owners or <br />occupants, or unreasonably diminish neighborhood parking availability. No Lot shall be <br />subdivided or split to create smaller lots, but Lots may be combined to establish a larger Lot. <br />Developer reserves the right to include Additional Property upon written notice to the Owners. <br />2. Garages and Outbuildings; Temporary Structures. All Dwellings on the Lots must <br />include a garage, which must accommodate at least one (1) car. The single outbuilding and chicken <br />coop per Lot shall be of the same quality and material construction as the outside finish and roof <br />of the residential structure. Out buildings and chicken coops may be constructed after or <br />simultaneously with the residence on each Lot, but shall not be constructed prior to the residence. <br />No building shall be constructed of unsightly materials, boxes or similar. No building or dwelling <br />shall be moved or placed upon a Lot. No trailer, tent, garage, shack or other unsightly outbuilding <br />shall be used as a Dwelling at any time, nor shall any structure of a temporary character be used <br />as a residence. No metal storage sheds are permitted to be on any of the Lot. Black chain link <br />fences are permitted. Grand Island, Nebraska, city installed street lighting is exempted from all <br />lighting restrictions. <br />3. Developer Control. So long as Developer owns at least one (1) Lot, it shall maintain <br />architectural control of the Property. ALL CONSTRUCTION ON ANY LOT REQUIRES <br />DEVELOPER'S PRIOR WRITTEN APPROVAL. Upon Developer no longer owning at least one <br />(1) Lot, the Association shall create an Architectural Control Committee to enforce this covenant. <br />4. Pets. Horses or livestock are not permitted. Subject to City Code compliance, <br />chickens, rabbits, dogs, cats and small "in-home" pets are permitted. The breeding of animals or <br />keeping of animals for any commercial purpose is not allowed. Complaints by homeowners of <br />unreasonable barking, rooster crowing, or destruction caused by pets will be referred to the City <br />of Grand Island, Nebraska, animal control authority. <br />4 <br />
