202402567 <br />DECLARATION OF COVENANTS, RESTRICTIONS AND CONDITIONS <br />THIS DECLARATION OF COVENANTS, RESTRICTIONS AND CONDITIONS is made this <br />day of June, 2024 by A & H Holdings, L.L.C., a Nebraska Limited Liability Company <br />("Developer") and A & H Holdings, L.L.C., a Nebraska Limited Liability Company and Alloway <br />Holdings, L.L.C., a Nebraska Limited Liability Company collectively referred to as "Owners". <br />DECLARATION OF PURPOSE <br />The undersigned as owners of the Lots, hereby adopt this Declaration of Covenants, Restrictions <br />and Conditions for the purpose of protecting the value and desirability of each of the Lots as <br />defined herein and which shall run with the land and be binding on all parties having any right, <br />title or interest in any one of the Lots, their heirs, successors and assigns. <br />ARTICLE I. <br />DEFINITIONS <br />The following words, phrases or terms used in this Declaration shall have the following <br />definitions: <br />1. "Additional Property" means any Property, together with all improvements thereon <br />that is subsequently added in Developer's discretion and is subject to this Declaration, including, <br />but not limited to Lots Eleven (11) through Twenty Six (26) inclusive in Highland North Second <br />Subdivision and unplatted landed owned by Developer located in the Northwest Quarter (NW1/4) <br />of Section Two (2), Township Eleven (11) North, Range Ten (10) West of the 6th P.M., Hall <br />County Nebraska. <br />2. "Association" shall mean Highland North HOA, Inc., a Nebraska Nonprofit <br />Corporation. <br />3. "Declaration" means this Declaration of Covenants, Restrictions and Conditions. <br />4. "Developer" shall mean A & H Holdings, L.L.C., a Nebraska Limited Liability <br />Company, its successors and assigns. <br />5. "Developer Control Period" means the period commencing upon recording of this <br />Declaration and ending as provided in Article II, Section 3. <br />2 <br />
