The final 10% of Trust Funds may not be requested until all of the following are submitted to the Department: (a) A Certificate of Occupancy. (b) A Cost Certification. (c) Certification of Compliance Form, documenting that the newly constructed housing units, as built, meet the plans and specifications as approved by the Nebraska Department of Environment & Energy and comply with the most recent version of the International Energy Conservation Code. §1.02 Use of Trust Funds; Eligible Expenses. The Trust Funds awarded to the Recipient must be used for the Project, which is more particularly described in the Application and in Paragraph C of the RECITALS. The Trust Funds may only be used for the stated and approved purposes set forth in the Application and this contract. Trust Funds are not eligible to be invested in properties located within the 100 - year floodplain. The only expenses that can be incurred prior to Release of Funds are general administration expenses. Release of Funds is the award stage in which funds may be released to the Recipient for reimbursement of eligible expenses. No funds may be released by the Department until the special conditions are met. Project costs cannot be obligated or incurred prior to the Department issuing a written Notice of Release of Funds. Upon receiving the "Notice of Release of Funds" letter, the Recipient may obligate both administrative and non- administrative costs and draw down funds for eligible costs incurred. A Release of Funds will not be approved if there are any unresolved audit findings relating to a past award and remains unresolved beyond the normal period or is deemed to be extreme misconduct. §1.03 Time of Performance. The time of performance under this contract will be from October 18, 2023 to April 30, 2027 ("Time of Performance"); therefore, the termination date of this contract will be April 30, 2027 ("Termination Date"). All Project activities must be completed by the Termination Date; however, this contract will continue in effect until the affordability period for the Project is complete and all related requirements are fulfilled. §1.04 Incorporation of RECITALS Paragraphs as Agreed Terms of Contract. All provisions of the RECITALS above are incorporated as agreed provisions of the contract. PART II: SPECIAL CONDITIONS FOR RELEASE OF FUNDS. Funding of the amount stipulated in §1.01 will not occur until the following Special Conditions for Release of Funds are met.
