202305141 <br />M. Froeschl; and <br />NOW, THEREFORE, in consideration of the promises and the mutual <br />covenants and agreements hereinafter contained, the parties agree as follows: <br />1. JURISDICTION: The Plaintiff is and has been a resident of <br />Nebraska for more than one year prior to the filing of the Complaint for <br />Dissolution of Marriage in the above -captioned matter; and further, neither party <br />is a member of the military services on active duty or otherwise entitled to relief <br />under the Service members Civil Relief Act of 2003. The parties hereby <br />specifically acknowledge and submit themselves to the jurisdiction of the District <br />Court of Hall County, Nebraska, with regard to all matters relating to the subject <br />matter and rights of the parties under this Agreement. <br />2. EFFECTIVE DATE: This Agreement shall become binding upon <br />the parties and their respective legal representatives, successors, and assigns <br />immediately following the dissolution of their marriage in the pending <br />proceedings providing that the provisions of this Agreement are approved by the <br />Court. <br />3. CHILD CUSTODY: The parties are the parents of two (2) minor <br />children namely, Ethan Briseno, born October 2012, and Xavier Briseno, born <br />October 2009 (the "minor children") whose custody and welfare are affected by <br />these proceedings. The parties stipulate and agree that they shall be awarded the <br />joint legal and joint physical custody of the minor children, subject to the <br />parenting time, rights and responsibilities as set forth in the Parenting Plan of the <br />parties attached hereto as Exhibit "A," and incorporated by reference as if fully <br />set forth herein. The parties agree that Exhibit "A," and the terms and provisions <br />therein are in the best interest of the minor children and should be adopted into a <br />final Decree of Dissolution of Marriage. <br />4. REMOVAL FROM JURISDICTION: The parties hereby <br />acknowledge that if in the future either party should decide to move from the <br />State of Nebraska with the minor children, that party acknowledges that he or she <br />has been advised and understands that application must first be made with, and <br />approval granted by the Hall County District Court prior to the time of such <br />move. <br />5. CHILD SUPPORT: Plaintiff shall pay child support for the benefit <br />of the minor children in the amount of $458.00 commencing the first day of the <br />month following entry of a Divorce Decree adopting the terms of this Settlement <br />Agreement and continuing on the 1St day of each month thereafter.
