202301743 <br />2. Dissolution of Marriage. The parties were married on July 8, 2004, <br />in Grand Island, Hall County, Nebraska. Three children were born during this <br />marriage, namely: Desiree Sanchez, born in 2001, Nathan Sanchez, born in 2004, <br />and Yeleyna Sanchez, born in 2006, however only Nathan and Yeleyna's welfare <br />and custody will be affected by these proceedings. The marriage of the Plaintiff and <br />the Defendant is irretrievably broken and every reasonable effort to effect <br />reconciliation has been made. <br />3. Custody and Parenting Time. The Court finds that the Defendant <br />shall have the sole legal and sole physical custody of the parties' minor children, <br />Nathan Sanchez, born in 2004, and Yeleyna Sanchez, born in 2006, subject to the <br />Plaintiffs parenting time as set out in the Mother's Proposed Parenting Plan <br />(Exhibit 29) as adopted by the Court and attached as part of this decree. In making <br />a determination regarding custody, the Court must consider the requirements of <br />Neb. Rev. Stat. §43-2923(6). <br />From the testimony of the parties, as well as the testimony of the parties' <br />minor children, it is clear that the minor children have a strained relationship with <br />the Plaintiff. The Plaintiff has not had any consistent parenting time with the minor <br />children, and has not worked with the minor children's therapists to rebuild his <br />relationship with the minor children. The minor children testified that they do not <br />wish to have any parenting time with the Plaintiff. The Court finds these desires <br />and wishes from the children to be based on sound reasoning. It is clear that the <br />Defendant has provided for the health, welfare, and social behavior of the children <br />during the parties' separation. At the time of trial, there was testimony from the <br />Defendant and the parties' children to establish credible evidence of child abuse <br />inflicted on the parties' minor children by the Defendant. The Plaintiff himself <br />testified to using objects to physically discipline his minor children. Based on the <br />factors outlined in Neb. Rev. Stat. §43-2923(6), the Court finds that it is in the <br />minor children's best interests for the Court to grant the Defendant the sole legal <br />and sole physical custody of the parties' minor children, Nathan Sanchez, born in <br />2004, and Yeleyna Sanchez, born in 2006. <br />4. Child Support. The Plaintiffs temporary child support obligation of <br />$750.00 per month for the support of the parties' two (2) minor children shall <br />terminate effective April 30, 2022. Beginning May 1, 2022, and continuing the first <br />day of each month thereafter, the Plaintiff shall pay child support in the amount of <br />Pam* of aV <br />2 <br />
