20OOiO t <br />(C) For the purposes of the Condominium Documents, the term "Board" and "Board <br />of Directors" shall refer to and be the same as the term "Executive Board" which may be found <br />in the Nebraska Uniform Condominium Act. <br />(D) The Board shall adopt a budget for maintaining the Common Areas. Within thirty <br />(30) days of the adoption of the proposed budget, the Board shall provide a summary of the <br />budget to all Unit Owners and set a date for a meeting of the Unit Owners to consider ratification <br />of the budget as provided in the Bylaws. Unless, at that meeting, the budget is rejected by a <br />majority vote of all the votes in the Association, the budget shall be considered ratified, whether <br />or not a quorum is present. In the event the proposed budget is rejected, the periodic budget <br />last ratified by the Unit Owners shall be continued until such time as the Unit Owners ratify a <br />subsequent budget proposed by the Board. <br />15. Maintenance and Service ResponsibilitX. <br />(A) Owner: <br />(i) Any alteration, relocation, enlargement, or modification of utilities shall be <br />at the Owner's expense, which expense shall include all expenses <br />incurred by the Association in reference thereto. Utilities shall not be <br />altered, relocated, enlarged, or modified by an Owner without the prior <br />written consent and approval of the Board or its designee, which consent <br />and approval shall not be unreasonably withheld. <br />(ii) Each Owner shall be responsible for maintenance, repair and <br />replacement of his or her Unit unless otherwise provided in this <br />Declaration. <br />(iii) Notwithstanding any provision herein to the contrary, an Owner shall be <br />solely responsible for any damage anywhere in the Project caused by <br />Owner's or its Guest's actions, intentional or negligent. <br />(B) Association: <br />(i) The Association shall have the duty of maintaining and repairing all of the <br />Common Elements, subject to the provisions in Subparagraph (A) <br />immediately above, and Association property, and the cost of such <br />maintenance and repair shall be a Common Expense of all of the <br />Owners. <br />M <br />
