200O1030f <br />No labor performed or materials furnished and incorporated in a Unit with the consent of <br />or at the request of the Owner thereof or his /her agent, contractor, or subcontractor, shall be the <br />basis for the filing of a lien against all or any portion of the Condominium Unit of any other <br />Owner not expressly consenting to or requesting the same. Each Owner shall indemnify and <br />hold harmless all of the Owners from and against all liability arising from the claim of any <br />construction performed, or for labor, materials, service, or products incorporated in the Owner's <br />Unit at such Owner's express or implied request. <br />13. Nuisances and Lawful Use. <br />(A) No nuisances shall be allowed or permitted upon the Project or any property in <br />which the Association owns an interest, nor shall any use or practice which is the source of <br />annoyance to occupants or which interferes with the peaceful possession and proper use of the <br />Project (or any property in which the Association owns an interest) by the occupants thereof be <br />suffered or permitted. All parts of the Project shall be kept in a clean, attractive, and sanitary <br />condition, and no rubbish, refuse, or garbage shall be allowed to accumulate, nor any fire <br />hazard suffered or permitted to exist. <br />(B) No immoral, improper, offensive or unlawful use shall be made of the Project or <br />any property in which the Association owns an interest, or any part thereof, and all valid laws, <br />zoning and other ordinances, rules and regulations of all governmental bodies having <br />jurisdiction over the Project shall be observed. The responsibility of meeting the requirements <br />of governmental bodies for maintenance, modification, or repair of the Project shall be the same <br />as the responsibility for the maintenance and repair of the Project concerned. <br />14. Administration and Management. <br />(A) The administration of the Project shall be governed by the Condominium <br />Documents and decisions and resolutions of the Association or the Board. The Association <br />shall possess all of the powers enumerated in the Nebraska Uniform Condominium Act and <br />those necessary to govern, manage, maintain, repair, administer, and regulate the Project and <br />to perform all of the duties required of it, including without limiting the generality of the foregoing, <br />the authority to grant, by and through the Board, utility (including but not limited to electricity, <br />gas, water, telephone, cable television and sewer) service easements in, over, and under the <br />Common Elements. Except as otherwise provided in the Condominium Documents, all powers <br />and duties of the Association shall be exercised by and through the Board of Directors. <br />(B) Each Owner of a Condominium Unit shall become a Member of the Association <br />upon conveyance to him /her of his /her interest in a Condominium Unit and shall remain a <br />Member for the period of his /her ownership. <br />-7- <br />
