20,2,1;J533R <br />4.16.2 Vehicle Repair. Minor repairs of vehicles are allowed as long as the <br />repair is completed, or the vehicle being repaired is moved into a closed garage, no <br />later than nightfall each day. However, vehicles shall not be left on ramps or blocks, <br />and no major repairs shall be allowed. No vehicle shall be constructed, <br />reconstructed, or repaired on any Lot. Except for emergency repairs, no vehicle <br />shall be constructed, reconstructed or repaired on the Streets or any other part of <br />the Common Area. No inoperable vehicle may be stored or parked on the Streets <br />or any other part of the Common Area. <br />4.16.3 Parking. Parking is allowed on the street so long as any vehicle <br />parked on the street is moved every seventy-two (72) hours, in accordance with the <br />applicable city code. Should the applicable city code be amended to require <br />vehicles parked on city streets to be moved more frequently than every seventy-two <br />(72) hours, this covenant shall be deemed to be automatically amended to reflect <br />the new timeframe required by the applicable city code. Should the applicable city <br />code be amended to permit vehicles to remain parked on city streets for more than <br />seventy-two (72) hours, this covenant shall remain unchanged and any vehicle <br />parked on the street must be moved every seventy-two (72) hours. <br />Parking on the street is permitted in accordance with this Section 4.16.3, <br />provided the vehicle in question does not exceed eight feet (8') in height and does <br />not exceed twenty-two feet (22') in length. <br />No vehicle of any kind may be stored on a Lot except in a garage, and no <br />vehicle of any kind may be stored on any Common Area. For purposes of <br />illustration, but not of limitation, a vehicle shall be deemed stored if it is covered <br />by a car cover, tarp, or other material. Vehicles owned by a guest of an Owner or <br />Resident may be parked in the driveway on a Lot or on the Street or in designated <br />parking spaces on the Common Area. <br />Residents of a Lot shall be permitted to park (on the driveway, driveway <br />expansion, and any street adjacent to such Lot) only that number of vehicles <br />equivalent to the number of licensed drivers living at the Lot, limited to a maximum <br />of four (4) vehicles, except while engaged in transport. Such vehicles shall have <br />current license plates and valid registration and shall be operable and not leaking <br />fluids. Loud exhausts and flat tires of such vehicles must be repaired immediately. <br />All parking spaces shall have a concrete surface. All open off-street parking areas <br />shall be a minimum of 20 feet (20') in length and 10 feet (10') in width. <br />The Board shall have the right and power to adopt rules and regulations <br />governing and further restricting the parking of Motor Vehicles on Lots or the <br />streets and implementing the provisions of this Section. In the event of any conflict <br />or inconsistency between this Section and the rules and regulations adopted by the <br />Board, this Section shall control. <br />4. Section 4.20 of the Covenants shall hereafter appear and read as follows: <br />4.20 Plav2round Equipment; Basketball Backboards. <br />Jungle gyms, swing sets, playhouses, and other children's playground equipment <br />will be permitted in the backyards and side yards of Lots so long as the same do not come <br />past the front footprint on the house. Basketball backboards and hoops are permitted on <br />the front driveway of each Lot. <br />Plans for play structures and similar recreational equipment must be submitted to <br />the DRC for approval. This is not to eliminate play structures, but to consider privacy <br />issues for adjacent neighbors and to assure the aesthetic appeal. <br />The maximum height that will be considered for approval of swing sets is ten feet <br />(10'). The maximum height for any deck or platform is four feet (4') above ground level. <br />The play structure may be placed no closer than five feet (5') to any Lot line. When <br />considering plan approval, the DRC will consider the appearance, height, and proximity to <br />
