Submittals must include a picture or brochure of the structure, total <br />dimensions, materials, and a plot map or drawing indicating the proposed location and its <br />proximity to adjacent Lot lines. <br />5. Section 4.25 of the Covenants shall hereafter appear and read as follows: <br />4.25 Flagpoles and Flags. <br />A flagpole may be installed without the prior approval of the DRC. The <br />official flag of the United States, the State of Nebraska, and the Armed Forces (such <br />as U.S. Army, U.S. Navy, U.S. Air Force, U.S. Marine Corps, U.S. Coast <br />Guard)and POW/MIA flags and university logo flags may be displayed on any Lot <br />provided (a) such flag is displayed from a pole attached to a Residence on the Lot <br />or buried in the ground, (b) the pole is no higher than the top of the Residence, (c) <br />the pole is no longer than ten feet (10') in length and does not extend more than ten <br />feet (10') from the edge of the Residence, if attached to the Residence, (d) any flag <br />lighting does not violate Section 4.22, and (e) the flag is maintained in good <br />condition. <br />6. Section 4.27 of the Covenants shall hereafter appear and read as follows: <br />4.27 Storage Sheds. <br />Storage sheds are permitted on any Lot. If a Lot owner wishes to construct <br />a storage shed that will be Visible From Neighboring Property, plans must be <br />submitted to the DRC for approval. The maximum height to the top of the wall of <br />any storage shed shall be nine feet (9'), the pitch of the roof must be the same as <br />the Residence, or no less than a 3/12 pitch, and storage sheds shall not exceed one <br />hundred twenty (120) square feet in size. No roof -mounted equipment is permitted. <br />Storage structures must be free standing and not attached to the Residence. All <br />exterior architectural detail, roof materials, color, etc., must match the body of the <br />Residence. <br />7. Section 5.9 of the Covenants shall hereafter appear and read as follows: <br />5.9 Pools and Spas. <br />(a) In addition to DRC approval and compliance with the requirements set forth on <br />Exhibit E to this Declaration, all pools and spas must be installed according to local <br />and/or state law and will require protective fencing and be subject to certain <br />setbacks. <br />(b) The location and screening of, and sound -insulating materials for, pool pumps and <br />other equipment shall be subject to prior approval of the DRC. The open end of <br />the screen wall will require a gate, landscaping, or return wall to ensure the <br />equipment is not Visible From Neighboring Property. All screening shall match as <br />closely as possible the color and materials of the Residence, to give the appearance <br />of being an integral part of the architecture of the Residence. <br />(c) Above -ground pools, spas, or hot tubs are permitted on Improved Lots upon <br />approval by the DRC but may not be installed outside the side footprint of the <br />Residence, unless within a full fence that is at least six feet (6') tall where visible <br />from the street from the front of the Residence and not past the front footprint of <br />the Residence. <br />(d) Pools may not be backwashed into washes, Common Areas, drainage ways, or <br />streets. All backwash water must be contained on the Owner's Lot. <br />8. Except as amended hereby, the Covenants shall remain in full force and effect. <br />9. This Amendment shall run with the land and shall be binding upon and shall inure <br />to the benefit of the Owners of the lots identified hereinabove and their legal representatives, <br />successors and assigns. <br />4 <br />
