202105332 <br />Lots One (1) through Forty -Three (43), together with Outlot "A", in Copper Creek <br />Estates Eighth Subdivision, an Addition to the City of Grand Island, Hall County, <br />Nebraska. <br />WHEREAS, pursuant to Section 12.3 of the Covenants, the Covenants may be amended <br />on the affirmative vote at least Seventy -Five Percent (75%) of the total votes in Copper Creek <br />Estates Community Association, Inc.; <br />WHEREAS, more than Seventy -Five Percent (75%) of the total votes in Copper Creek <br />Estates Community Association, Inc. have been cast in support of amending the Covenants as <br />detailed in the foregoing in accordance with Section 12.3 of the Covenants. <br />KNOW ALL MEN BY THESE PRESENTS: <br />1. The recitals appearing hereinabove are hereby specifically incorporated herein and <br />made a binding part hereof by this reference. <br />2. Section 4.9 of the Covenants shall hereafter appear and read as follows: <br />4.9 Trash Containers and Collection. <br />Declarant and Association reserve the right to provide or subcontract for <br />garbage pickup. In the event that Declarant or the Association provide or <br />subcontract for garbage pickup, each Owner agrees to contract with the Declarant <br />or Association, or its designated subcontractor, for his or her own garbage pickup. <br />Garbage must be picked up a minimum of once per week at the Owner's expense. <br />All refuse, papers, and garbage bags shall be stored in proper refuse containers <br />between garbage pickup days. If refuse containers are provided by the contractor <br />providing refuse collection, such containers shall be the only ones used for refuse <br />disposal. Garbage shall be placed at curbside no sooner than the evening prior to <br />the designated pickup day. Refuse containers or recycling bins shall be kept in the <br />garage or against the house and kept in a clean and orderly fashion. Except as <br />specifically provided herein, refuse piles or other unsightly objects or materials <br />shall not be placed upon the Property. All receptacles or other equipment for the <br />storage or disposal of refuse materials shall be kept in a clean and sanitary <br />condition. No Lot, easement, or Common Area shall be used or maintained as a <br />dumping ground for rubbish. Trash, garbage, grass clippings, and other waste shall <br />be disposed of in a sanitary manner and shall not be burned in incinerators, <br />barbecues, barbecue pits, or otherwise. <br />3. Section 4.16 of the Covenants shall hereafter appear and read as follows: <br />4.16 Vehicles, Vehicle Repair, and Parking. <br />4.16.1 Vehicles. No commercial -type vehicles, unlicensed vehicles, or <br />trucks shall be parked on the Property except while engaged in transport. For the <br />purposes of this Section, a one -ton or smaller vehicle, commonly known as a pickup <br />truck, shall not be deemed to be a commercial vehicle or truck. Recreational <br />vehicles are allowed to be parked on a cement pad poured in connection with the <br />driveway alongside the house and/or the driveway. Recreation vehicles shall not, <br />however, be parked in the driveway and shall not cause other vehicles to be parked <br />in street for longer than permitted hereunder. However, any campers, boats, <br />snowmobiles, all -terrain vehicles, and motor homes that can be and are stored <br />completely within garages and are not used for living purposes will not be a <br />violation of this Section. Large trucks (in excess of one ton) such as straight, semi, <br />cement, step vans, farm equipment, and similar vehicles shall not be operated or <br />parked anywhere on the Property. No go-carts or snowmobiles may be operated <br />anywhere on the Property. No vehicles shall be driven or parked on any unpaved <br />surfaces within the Property. Parking space for such vehicles will be provided <br />within the Property. <br />2 <br />
