202102287 <br />March 16, 2021 Resolution <br />Vacation of portions of 70th Road north of Schultz Road <br />(Including the curve on Alda Road - Link L40C) <br />WHEREAS, also in accordance with Neb. Rev. Stat. § 39-1724, the resolution setting the date for the public <br />hearing regarding vacation of the above described portion portions of 70`h Road north of Schultz Road <br />(including the curve on Alda Road - Link L40C) was also served by registered or certified mail upon the <br />owners of land abutting on or adjacent to the road to be vacated 2 weeks in advance of the public hearing; <br />WHEREAS, at 10:00 A.M. on March 2, 2021 the Hall County Board of Commissioners, acting in <br />accordance with Neb. Rev. Stat. § 39-1724, conducted a public hearing regarding the vacation of the above <br />described portions of 70th Road north of Schultz Road (including the curve on Alda Road - Link L40C) in <br />the county board room at 121 South Pine Street in Grand Island; and <br />WHEREAS, no members of the public presented any comments during the public hearing; and <br />WHEREAS, in accordance with Neb. Rev. Stat. § 39-1724, there has been nonuse of such right-of-way for <br />any public purpose for a continuous period of not less than 10 years, thus the right-of-way can revert to the <br />abutting property owners; and <br />WHEREAS, Tract # 1, as described above and shown on the attached survey record, containing 0.402 acres <br />more or less, was part of a larger purchase made by Hall County on September 24, 1958 for $375.00 as <br />recorded at the Hall County Register of Deeds Office in Book 125, page 429 and should revert to the <br />property the parcel was purchased from with a payment to the county for the estimated cost in preparing <br />details for the vacation of the right-of-way of $3,240 in accordance with Neb. Rev. Stat. § 39-1724; and <br />WHEREAS land in Hall County similar to that in track #1 is valued at approximately $3,500 per acre <br />(pasture ground); and <br />WHEREAS, Tract #'s 2 and 3, as described above and shown on the attached survey record, were part of <br />the original section line county road right-of-way at 66 feet wide and thus would revert to the property <br />owners of adjacent real estate one half to each side in accordance with Neb. Rev. Stat. § 39-1725. <br />Page 3 of 4 <br />
