202102287 <br />March 16, 2021 Resolution <br />Vacation of portions of 70th Road north of Schultz Road <br />(Including the curve on Alda Road - Link L40C) <br />LEGAL DESCRIPTION (TRACT #3) <br />A tract of land comprising a part of the of the Southwest Quarter or The Southwest Quarter (SW1/4 <br />SW1/4), Section Twenty (20), Township Ten (10) North, Range Ten (10) West of the 6th P.M., Hall <br />County, Nebraska. More particularly described as follows: <br />Commencing at the southwest corner of said SW1/4 SW1/4; thence N00°38'00"E on and upon the west <br />line of said SW1/4 SW1/4 a distance of 116.87 feet to the Point of Beginning; thence continuing thence <br />N00°38'00"E on and upon the west line of said SW1/4 SW1/4 a distance of 880.24 feet to a point on the <br />southerly right-of-way line of Alda Road; thence northeasterly around a curve in a counter -clockwise <br />direction, having a radius of 1353.24 feet, a chord bearing of N18°10'41"E and a chord distance of <br />109.47 feet, to a point on the easterly right-of-way line of Alda Road / 70th/ Road; thence S00°38'00"W <br />on and upon the east line of said 70th/ Road and parallel with the west line of said SW1/4 SW1/4 a distance <br />of 991.48 feet to a point on the northerly right-of-way line of Schultz Road; thence N77°37'29"W on <br />and upon the northerly line of said Schultz Road a distance of 33.07 feet to the Point of Beginning. <br />Said tract contains 0.707 acres more or less. <br />WHEREAS, at the February 2, 2021 pursuant to the above direction, the Hall County Highway <br />Superintendent presented a study of the uses of such road and submitted a report to the Hall County Board <br />of Commissioners, finding and recommending that the above described portions of 70th Road north of <br />Schultz Road (including the curve on Alda Road - Link L40C) be vacated; and <br />WHEREAS, on February 2, 2021, by Resolution 21-001, the Hall County Board of Commissioners, acting <br />in accordance with Neb. Rev. Stat. § 39-1724, set a public hearing regarding the vacation of the above <br />described portions of 70th Road north of Schultz Road (including the curve on Alda Road - Link L40C) for <br />March 2, 2021 at 10:00 a.m. in the county board room at 121 South Pine Street in Grand Island; and <br />WHEREAS, in accordance with Neb. Rev. Stat. § 39-1724, the resolution setting the date for the public <br />hearing regarding vacation of the above described portions of 70th Road north of Schultz Road (including <br />the curve on Alda Road - Link L40C) was published in the Grand Island Independent on February 13th, <br />20th and 27th of 2021; and <br />WHEREAS, notice of the public hearing regarding vacation of the above described portions of 70th Road <br />north of Schultz Road (including the curve on Alda Road - Link L40C) was also published in the Grand <br />Island Independent on February 19th, 2021; and <br />Page 2 of 4 <br />
