All construction and building shall be so performed that it will <br />comply with the requirements of the building codes and ordinances of Hall County, the State <br />of Nebraska, State Health Department rules and regulations relating to the construction <br />location of domestic wells and septic tanks, and Title 124 of the Nebraska Department of <br />Environmental Quality. <br />No cesspools shall be constructed or maintained or allowed to remain on any part of the <br />subdivision and all dwellings erected on said lots shall be serviced by septic tanks for sew- <br />age disposal until such time they may be served by a public or community sewer system. <br />Siting of the well and septic systems shall be in accordance to the placements designated on <br />a special plat maintained by the Board or the architectural committee for the subdivision, <br />unless otherwise agreed to by the Board of Directors and the Hall County Building Inspector. <br />10. Buildina Reauirements: Area Reauirements, Residential lots shall have no more <br />than one (1) dwelling thereon, unless such lot or combination of lots has been designated for <br />multiple -family use, townhouses, or condominiums by the Declarants. Each dwelling shall have <br />a minimum of fifteen hundred (1,500) square feet which shall include all space within the <br />dwelling, but not include the square footage of the garage, open porches, or basements. <br />11. Veaetation, The owner of each lot shall keep the vegetation and grass thereon <br />cut to a height less than eight inches. Prior to construction, an owner shall mow or cut all <br />weeds and grass on their lot <br />and keep the vegetation to a height less than eight inches. And beaches must be maintained <br />and kept clean of weeds, trash, and any other unsightly ejects. If the owner should fail to <br />maintain the lot or keep the vegetation cut to a height of less than eight inches, then the <br />Declarants or the Board may mow the lot and levy a special assessment and lien against the <br />property and its owner. <br />Lot owners desiring garden plots shall not cover or brace plants with plastic jugs, cans, plastic <br />bags or <br />other unsightly materials. At the end of the growing season, garden plots are to be cleared <br />of all decaying foliage and all garden equipment is to be stored out of sight. Areas devoted <br />to vegetable gardens shall not exceed an area in size that is larger, longer, or wider than <br />fifteen feet (15) by fifteen <br />(15) feet. No vegetable gardens shall be located in areas in front of homes. <br />12. Lake Usaae: Lake Carl and Lake Fred. The owner of any lot in the subdivision agrees to <br />use lake Fred and Lake Carl in such a manner as not to interfere with the use of the lake by any <br />other owner or in such manner as to create a nuisance, annoyance, or unlawful disturbance. The <br />owners of all lots shall be responsible for the conduct and safety of their guests. <br />All lot owners and occupants of the Amick Acres West Subdivision acknowledge that Lake <br />Fred and Lake Carl are potentially dangerous and there shall be no liability of any kind upon <br />the Declarants, owners, or homeowners association. The use of Lake Fred and Lake Carl by <br />any lot owner and their guest(s) shall be at the sole risk of the owner and guest(s) of the owner. <br />The use of Lake Fred and Lake Carl shall be restricted to owners of lots, and their guests. All <br />guests must be accompanied on the lake by their hosts. <br />13. Boat Docks. The design and materials of all docks, and boat storage garages must be <br />approved by the Board of Directors, or its designated committee. <br />14. Taxes. Any real estate taxes levied and assessed against the Amick Acres West <br />Homeowners Association shall be borne equally and paid by the members of the Amick Acres <br />West Homeowners Association through the annual assessments as described Article III., <br />7IPage <br />
