�42�4�46n <br />paragraph 4 <br />15. Removal of Sod. Earth. etc. No sod, earth, sand, gravel, or trees shall be removed to <br />the injury of the value or appearance of any lot, nor for commercial purposes, unless approved <br />by the Board of Directors, or its designated committee. <br />Any change in the elevation of a lot must be approved by the Board of Directors or its <br />designated committee. <br />16. Prohlbltlon orMotorBoats. No boats of any kind which are propelled byanytype of <br />gasoline or petroleum fuel motor or engine shall be permitted to be used upon or in the <br />lake. No boats belonging to guests are allowed on the lake. All boats to be used on the lake <br />must be owned by a lot owner and registered with the homeowners Association. A sticker <br />will be issued for each boat registered identifying their lot number on all boats owned by them <br />(human powered or electric powered) and the stickers must remain on the boats at all times. <br />17. Burping. Burning of trash from home waste rather than disposal through commercial <br />service or hauling to an approved disposal site is not allowed. Burning of brush, tree trimmings <br />is allowed subject to local or county ordinances. Fire pits or beach fires are permitted. The <br />owner is responsible for any fire started on their property. <br />ARTICLE III. <br />1. Formation of Association. The Amick Acres West Homeowners Association shall be a non- <br />profit Nebraska Corporation charged with the duties and invested with the powers prescribed by <br />lawand set forth in the Articles, Bylaws, and this Declaration. Neither the Articles, nor the Bylaws <br />shall, for any reason, be amended or otherwise changed or interpreted so as to be inconsistent <br />with this Declaration. It shall be the responsibility of the corporation to enforce all of the <br />covenants, restrictions and conditions contained in this Agreement. <br />2. Voting Memberships, The Amick Acres West Homeowners Association shall have two <br />(2) classes of voting memberships: One (1) share of Class A voting membership shall be issued <br />for each of lots one (1) through fifty- nine (59). Each holder of Class A voting membership is <br />entitled to one (1) vote for each share so issued. No shares shall be issued forthe Outlets, or Lots <br />sixty (60) through seventy-one (71) until such time they may be offered for sale and sold as <br />residential lots pursuant to Article II, paragraph #1. <br />3. TransferofClassAVotinaMembemhin. Upon the purchase of any lot within the Amick <br />Acres West Subdivision, Declarants, their successors and assigns shall transfer one share of <br />ClassAvoting membership in the Association to said purchaser and shall surrender one share <br />of Class B voting members inthe Association, which share shall cease to exist. The share of Class <br />Amembership shall run with the land and automatically be transferred to any new owner upon the <br />sale or other transfer of any lot or block in the Amick Acres West Subdivision. <br />4. Board of Directors/AnnualAssessment, ABoardof Directors shall consist of seven (7) <br />members with the positions being elected in a staggered manner. During the January 2020 <br />election four (4) positions will serve a term of one (1) year and the other three (3) positions will <br />serve a term of 2 years. Beginning with the January 2021 election the four (4) one (1) year term <br />positions will become two (2) year positions going forward. <br />8 1 P a g e <br />
