202101607 <br />(h) All personal property, including but not limited to: household goods, <br />furnishings, furniture, cash , checking, savings, bank accounts of any nature, <br />unsecured debts and personal effects of the parties have already been divided <br />and each of the parties should be awarded the property currently in their <br />possession. <br />(i) Each party shall all individually incurred debts since the May 28th 2008, and <br />indemnify the other party and hold them harmless there from. <br />0) That the parties shall be awarded the automobile in their respective <br />possessions. Each shall hold said vehicle to be theirs respectively, free and <br />clear of any claim by the other. <br />(k) All attorney fees and costs have been paid. <br />(1) That the Plaintiff certifies that she agrees with the entering of this Default <br />Decree with her consent to the execution of this Decree which has not been <br />obtained by fraud, duress or undue influence of any person; that no <br />representations of fact have been made by the Plaintiff except as herein <br />expressly set forth. <br />9. That the property division contained herein is found not to be unconscionable. <br />10. That the Plaintiff's name should be restored to Celsa Barrios DeLeon. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED: that the marriage <br />of CELSA BARRIOS PEREZ and FREDDY PEREZ DIAZ is hereby dissolved; for <br />purposes of review by appeal, the Decree shall be treated as a final Order as soon as it is <br />entered. If an appeal is instituted that does not challenge the finding that the marriage is <br />irretrievably broken, then the Decree shall become final and operative, as to that portion <br />of the Decree that dissolved the marriage, as if no such appeal had been filed. If an <br />appeal is instituted within thirty days after the date of the Decree is entered that <br />challenges the finding that the marriage is irretrievably broken, such Decree does not <br />become final until such proceedings are finally determined or the date of the death of one <br />of the parties to the dissolution, whichever occurs first. <br />Page 3 of10 <br />3 <br />
