202006448 <br />7. Vehicles, Rubbish. No worn out or discarded automobiles, machinery or parts thereof shall be stored <br />on Lots One (1) through Four (4) and Eight (8) through Fourteen (14) Thelen Fifth Subdivision and no <br />portion thereof shall be used for automobiles, junk piles or storage of any kind of junk or waste material. <br />No unused building material, junk or rubbish shall be left exposed on any lot except during actual <br />building operations. Campers, trailers, motor or mobile homes, boats, or recreational vehicles shall be <br />stored adjacent to the residence on a concrete pad; not stored on any lot, driveway or on the street in <br />front of or on the side of said lots. No commercial trucks or vehicles larger than a one -ton pickup truck <br />will be parked on any lot or driveway, or on the street in front of or on the side of said lots. <br />8. Vegetation. The Owner of each Lot shall keep the vegetation and grass thereon cut to a height less <br />than eight inches except for those areas on said lots used by the owner for vegetable or flower gardens <br />and except those areas planted to ornamental shrubs or grasses and trees. Prior to construction, an <br />owner shall mow or cut all weeds and grass on their lot and keep the vegetation to a height less than <br />eight inches. A lawn shall be planted within a year of final construction and shall be of a turf -type or blue <br />grass. Soil erosion must be controlled using an erosion control mat, straw bales, and/or ground cover. <br />The following tree species will not be planted: Cottonwood, Lombardy Poplar, White Poplar, <br />Green/White/Blue Ash, Austrian Pine, Scotch Pine, Russian Olive, Box Elder. <br />No trees may be planted on the city easement, beyond the deeded property boundary. <br />9. Easements and Utilities. Certain easements are established for installation and maintenance of <br />utilities, such easements being clearly marked on the recorded plat of said subdivision. Service lines for <br />individual residences for all public utility services, which are available to a lot from an underground <br />source, shall be kept underground. Exposed television aerials shall not be used, and no television aerial <br />or apparatus shall be visible on the outside of any building; provided however, an owner may be <br />permitted to install a satellite television receiver or a microwave television receiver as long as said <br />receiver is no larger than three feet in diameter. All cable television lines shall be underground where <br />available. <br />10. Sidewalks. The acceptance of a deed of conveyance by any purchaser or purchaser of any lot or Tots <br />shall be and amount to and be construed as consent thereto, and approval of sidewalks as determined <br />by the City of Wood River. <br />11. Signage. Signs placed on lots shall be no larger than ten (10) square feet and shall be only for <br />purposes of advertising the lot or dwelling for sale or construction by owner or contractor. <br />12. Building Codes. All construction and building shall be so performed that it will comply with <br />requirements of the building codes and ordinances of Hall County and the City of Wood River, Nebraska. <br />13. Terms of Restrictions. Modifications. These covenants, restrictions and conditions are to run with <br />the land and shall be binding on all persons and all parties claiming ownership of Lots One (1) through <br />Four (4) and Eight (8) through Fourteen (14) Thelen Fifth Subdivision, Restrictive Covenants for a term of <br />thirty (30) years from the date this Agreement is recorded after which time they shall be automatically <br />extended for successive periods of ten (10) years, unless changed or modified by a vote of a majority of <br />the then owners of the lots in said Subdivision. This agreement may be amended, or a variance granted, <br />during the first thirty (30) year period by an instrument signed by at least seventy percent (70%) of the <br />4 <br />
