20200644S <br />property owners in the Subdivision. Any amendment to this Agreement must be recorded with the <br />Register of Deeds of Hall County, Nebraska. <br />14. Remedies for Violations. If any owner of any lot, or their heirs or assigns, shall violate or attempt to <br />violate any of the covenants, restrictions and conditions herein set forth, it shall be lawful for any other <br />person or persons owning Lots One (1) through Four (4) and Eight (8) through Fourteen (14) Thelen Fifth <br />Subdivision, to prosecute such proceedings at law or in equity against the person or persons violating or <br />attempting to violate any such covenants or restrictions and to prevent him from so doing or to recover <br />damages for such violations. <br />In addition to the foregoing right, the City of Wood River, shall have the right to enter onto the property <br />of an owner whenever there has been constructed on the lot any temporary structures, signs, unused <br />parts thereof, weeds, underbrush, or other unsightly growth or objects in breach of these restrictions <br />and to abate or remove the same at the expense of the owner, and any such entry and abatement or <br />removal shall not be deemed a trespass. The failure to promptly enforce any of the covenants, <br />restrictions or conditions of this Agreement shall not in any way be deemed a waiver of their <br />enforcement. <br />15. Covenant Declared Void. If any of the covenants, restrictions or conditions herein set forth are <br />violated and declared void by a court of competent jurisdiction, the remaining covenants, restrictions or <br />conditions shall not be affected but shall stay and remain in full force and effect. <br />16. Agreement Binding.
