20200644S property owners in the Subdivision. Any amendment to this Agreement must be recorded with the Register of Deeds of Hall County, Nebraska. 14. Remedies for Violations. If any owner of any lot, or their heirs or assigns, shall violate or attempt to violate any of the covenants, restrictions and conditions herein set forth, it shall be lawful for any other person or persons owning Lots One (1) through Four (4) and Eight (8) through Fourteen (14) Thelen Fifth Subdivision, to prosecute such proceedings at law or in equity against the person or persons violating or attempting to violate any such covenants or restrictions and to prevent him from so doing or to recover damages for such violations. In addition to the foregoing right, the City of Wood River, shall have the right to enter onto the property of an owner whenever there has been constructed on the lot any temporary structures, signs, unused parts thereof, weeds, underbrush, or other unsightly growth or objects in breach of these restrictions and to abate or remove the same at the expense of the owner, and any such entry and abatement or removal shall not be deemed a trespass. The failure to promptly enforce any of the covenants, restrictions or conditions of this Agreement shall not in any way be deemed a waiver of their enforcement. 15. Covenant Declared Void. If any of the covenants, restrictions or conditions herein set forth are violated and declared void by a court of competent jurisdiction, the remaining covenants, restrictions or conditions shall not be affected but shall stay and remain in full force and effect. 16. Agreement Binding. This Agreement and the faithful performance of the terms thereof shall be binding upon the heirs, administrators, executors, assigns, grantees and devisees of the parties to this contract, and upon the purchaser or purchasers of Thelen Fifth Subdivision.
