202006448 <br />6.) No fence shall be constructed closer to the street than the front elevation of the building. No chain <br />link fences of any type shall be constructed upon Lots One (1) through Fourteen (14) Thelen Fifth <br />Subdivision, except for dog pens. Maximum area of such pens shall be one hundred twenty (120) square <br />feet and shall be on a concrete pad. No dog runs shall be located in a front yard or within five (5) feet of <br />a lot line. <br />7.) Any solar panels placed on any residence constructed on any lot shall be mounted flush with the roof <br />of such residence, and shall not be located along any exterior wall of such residence or in any yard area <br />of any lot. <br />8.) Upon transfer of title, construction of dwelling must start within Three (3) years. Each dwelling will <br />then have one year to be completed. If the same individual or entity purchases multiple lots, the <br />previously mentioned time restrictions will be extended an additional year for each additional lot <br />purchased. In the event the time restrictions previously mentioned are not met, Thelen Grain Company, <br />Inc. or its successors and assigns shall have the option to repurchase the lot for the amount paid for the <br />lot. A written notice to the titleholder of the lot will exercise the option. <br />B. Garages and Outbuildings. All dwellings on residential lots must include a garage, which must <br />accommodate at least two (2) cars. All garages must be attached directly or connected thereto by a <br />breezeway or similar structure. All garages and outbuildings shall be of the same quality and material of <br />construction as the outside finish and roof of the residential structure. Outbuildings may not exceed six <br />hundred (600) square feet. Sidewall height of any detached garage or outbuilding will not exceed ten <br />feet (10'). No garage or outbuilding shall be constructed of unsightly materials, boxes, or similar lumber. <br />No garage or outbuilding shall be moved into the subdivision and placed upon a residential lot. No metal <br />or plastic storage sheds shall be permitted to be on any of the lot. <br />3. Exterior Lighting. No mercury or sodium vapor lights are allowed on any lot. No overhead flood lights <br />or "dusk to dawn" pole lights are allowed. Street lighting by the City of Wood River shall be exempted <br />from all lighting restrictions. <br />4. Drainage. Lot drainage and associated structures to accomplish the desired result will be as directed <br />by the engineer of the City of Wood River. Lot elevations will be made to avoid any excess water <br />drainage onto adjacent property. The top of the foundation on any dwelling will not be more than <br />thirty-two inches (32") above the curb height at the front of the lot. <br />5. Setback Requirements. All buildings shall be placed on the lot in accordance with the setback <br />requirements of the City of Wood River. All such measurements shall be computed from the foundation <br />of the structure to the nearest property line. Any concrete pads placed for parking or any other purpose <br />will honor the same setback requirements as those in place for building structures. <br />6. Pets. No barns, chicken houses, house trailers, commercial work or sales shops, or other buildings for <br />the care and housing of fowl, rabbits or livestock shall be placed, maintained or used on any lot, nor <br />shall any fowl, rabbits or animals other than household pets be kept upon any lot, and household pets <br />shall not be kept, fed or maintained for any commercial purpose. Pets such as dogs or cats are <br />permitted, but shall be kept restrained. Complaints of unnecessary barking or destruction caused by <br />pets will be referred to the appropriate authorities of the City of Wood River <br />3 <br />
