202000449 <br />RESTRICTIVE COVENANTS. RESTRICTIONS AND CONDITIONS <br />Lots One (1) through Four (4) and Eight (8) through Fourteen (14), Thelen Fifth Subdivision, all as <br />surveyed and platted and more particularly described as recorded in Thelen Fifth Subdivision, Restrictive <br />Covenants the office of the Register of Deeds of Hall County, Nebraska, that are sold, transferred and <br />conveyed, shall be and are subject to the following protective covenants, restrictions and conditions: <br />1. Use of Lots. Lots One (1) through Four (4) and Eight (8) through Fourteen (14) Thelen Fifth <br />Subdivision, shall be known and described as residential lots. No structure shall be erected, altered, <br />placed or permitted to remain on any lot other than one dwelling and a private garage for not more <br />than three (3) cars, and other secondary buildings incidental to the residential use of the plot. No <br />dwelling shall be erected for occupancy for more than one family, nor shall any dwelling be used for <br />occupancy of more than one family. No structure of a temporary character shall be used as a residence. <br />No commercial or business enterprise shall be conducted or operated on Lots One (1) through Four (4) <br />and Eight (8) through Fourteen (14) Thelen Fifth Subdivision. Lot Fourteen (14) may be divided or split <br />into no more than three smaller lots. No other lot or lots shall be divided or split to create smaller <br />building areas, but lots may be combined or combined and divided, to establish building areas. <br />2. Construction and Area Requirements. <br />A. Dwellings. Each residential lot shall have no more than one (1) dwelling thereon. <br />All dwellings shall meet the following minimum square feet requirements; which minimum square <br />footage shall not include garages or open porches: <br />1.) Dwellings placed on lots with an average width of one hundred ten (110) feet or more shall have a <br />minimum of one thousand five hundred (1500) livable square feet on the first level which shall be above <br />ground. Dwellings placed on lots with an average width of less than one hundred ten (110) feet shall <br />have a minimum of one thousand two hundred fifty (1250) livable square feet on the first level which <br />shall be above ground. <br />2.) The minimum livable square footage of any two-story, split level or split -foyer type dwelling shall be <br />one thousand five hundred (1500) livable square feet combined above ground and the finished sub- <br />basement of the dwelling shall not be included in computing the minimum livable square footage. <br />3.) Each dwelling on each residential lot shall have a roof constructed of architectural style shingles, with <br />25 -year warranty. The slope of each dwelling roof shall be a 5/12 pitch or more. No dwelling or other <br />structure will have corrugated sheet -metal roofing or siding material. <br />4.) Each dwelling on each residential lot shall have standard lap siding. Siding material will be wood, <br />vinyl, standard composite or steel lap siding. Stucco, brick, stone and masonry trim and exterior wall <br />covering shall be acceptable. Exterior wall covering will be of colors that are conventional and standard, <br />as available from reputable lumberyards, siding vendors and painting contractors, at the time of <br />construction. <br />5.) No dwelling house shall be moved onto and placed upon Lots One (1) through Fourteen (14) Thelen <br />Fifth Subdivision nor shall manufactured housing, mobile homes or trailers be allowed on said lots. <br />2 <br />
