401" - <br />THELEN FIFTH SUBDIVISION <br />AGREEMENT FOR <br />RESTRICTIVE COVENANTS. RESTRICTIONS AND CONDITIONS <br />CO <br />CO <br />THIS DECLARATION of Restrictive Covenants, Restrictions and Conditions of Thelen Fifth Subdivision is <br />made this 26th day of August , 2020 by Thelen Grain Company, Inc., hereinafter referred <br />to as " Declarants", for itself, to its successors, grantees and assigns. <br />DECLARATION OF PURPOSE <br />WHEREAS, Declarants are the owners of real property in Hall County, Nebraska, which is more <br />particularly described as: <br />Lots One (1) through Four (4) and Eight (8) through Fourteen (14) Thelen Fifth Subdivision, City of Wood <br />River, Hall County, Nebraska. <br />all as more specifically described in the plat of said Subdivision as the same is recorded in the office of <br />the Register of Deeds of Hall County, Nebraska; and <br />WHEREAS, Declarants desire to provide for the construction of a planned residential area consisting of <br />single family residences and to improve Lots One (1) through Four (4) and Eight (8) through Fourteen <br />(14) Thelen Fifth Subdivision, by encouraging the sale of lots and the construction of modern and <br />desirable dwelling houses; <br />NOW THEREFORE, in consideration thereof, and in consideration of the mutual benefits to be derived by <br />the Declarants and by any subsequent purchaser, the Declarants stipulate and agree as Lots One (1) <br />through Four (4) and Eight (8) through Fourteen (14) in said subdivision are sold, transferred and <br />conveyed, shall be and are subject to the following protective covenants, restrictions and conditions. <br />Said covenants, restrictions and conditions are for the purpose of protecting the value and desirability <br />for the lots within Thelen Fifth Subdivision and shall run with the real property and be binding on all <br />parties having any right, title or interest in the lots, or any part thereof, and shall run with the land and <br />inure to the benefit of each owner thereof. <br />1 <br />3� � <br />
