<br /> Environmental Law and in the ngulations promulguted theneunder. ,

<br /> "ImFtovements„mean the buildings,stnxctures and other improvements(if any)presently
<br /> - _-= located on the Real Property.

<br /> - "Indcannitee" means the Mortgagee, itt� Parti:,ipants in the Loan and all subsequent -
<br /> ; holders of the Mortgage,their respective successors and assigns,their respective of�'icers,directors,
<br /> _- °�-- employees,agents,representarives,contractors and subcontractors and any subsequent ovmer of the
<br />--�1 Real Property who acquires ritlo thereto from or through the Mortgagee.

<br /> .:a:�,,,� Envizonmental Response,Campensation and Liability Act of 1980,�s amended(42 U.S.C.Sections

<br /> - - (b) Mortgagor covenants and agrees with Mortgagee as follows:
<br /> --�"` (ii) Mortgsgor shall keep and shall cavse all operators,tenants,subtenants,licensees and
<br /> ��'"'� occupants of the Itral Property to keep the Real Property free of all Ha7ardous Substances and shall _
<br /> -- . not cause or permit the Real Prot�etty or any part theteof to be used for the storaste,heatment,
<br /> --_ _ generation, transportation, processing, handling, produstion or dispossil of any Hazardous
<br /> �' SubsKances,except in the nom�al operarion of the Real Property for the use as a Wtudy's Rcstauraut
<br /> � and otherwise in,a�ccordance with all Environmental Laws.
<br /> (ii) Mortgagor shall comply with, and shall cause all operators,ten$nts, subtenants,
<br /> � licensers and accupants of ihe Real Pzoperty to comply with ull applicable Environmental Laws and
<br /> ' shall obtain and comply with, and shall cause all operators, tcnants, subienants, liecnsees and
<br /> �� cecupants of the Real Properiy to obtain and comply with all Environmental Permits.
<br /> (iii) Mortgagor shall not cause or pzmiit any changa to 6e made in the present or
<br /> __ intended use of the Rea! Property which would (i) involve the storage, treatment, generation,
<br /> -- transportation,processing,handling,productian or disposa!of any Hazazdous Substance or the use
<br /> - of the Real Property as a landfill or other waste disposal site or for military, manufacturing or
<br /> -- indushial putposes or for the storage of petroleum or petroleum based producYs,(ii)violate any
<br />__-_=3 appucable Environmental Law,(iii)consritute n�n-compliance with any Environmental Permit or
<br /> __- (iv)increase the risk of Release.

<br />_r;,��� (iv) Ivtortgagor shall promptly provide Mortgagee with a copy of all notifications which
<br />-�� it gives or receives with respect to any past or present Release or the ttzreat of a Release on,at or
