<br />-- testing for Hazardot�Substatbces required by Mortgagee and,in accordance rvith all Envirc�ninental
<br /> .:�;;;;� Laws, all removal and other remedial actions necessary to contain, remove and clean up all
<br /> '`�� HaTardous Substances that are determined to be present at the Real Property in accordance with all
<br /> �"=�� applicable Environmental Laws and all Environmental Psrmits.

<br /> _~� (vi) Mortgagor shall at all time allow Mortgagee and its officers,employees,agents,
<br />_=='� representatives, contractors and subcontractors reasonable access to the Real Properiy for the
<br />----_= purpose of ascertaining site condirions, including, but not limited to, subsurface conditions.
<br />__ -- Mortgagae sliall hav�the right,but not the obligation,to cure any violation of the Environmental
<br />-;;,�� Laws causcct or suffered by Mortgagor;and all costs and expenses incurred by Mortgagee to effect _
<br />`=�=�� such cu*e shall be immediately reimbursed to Mortgagee upon demand.
<br />--`��� (vii) �f at any time Mortgagee obtains any evidence or information whi.ch su�gests that
<br /> `�;;�,,,.��,� potential environmental problems may exist at the Real Propetty,Mortgagee may require that a full
<br />-_�=-- or supplemental environmental inspection and audit report with respect to the Real Property of a
<br /> _- - scope and level of detail satisfactory to Mortgagee by prcpared by an environmenta]engineer or
<br /> �`���� other qualified person aeceptable to Mortgagee,at Mortgagor's expense. Said audit ma�include
<br /> �-"� a physical inspection of ihe Real Pmperty,personnel interviews and a review of all Environmental
<br />-_ - Permits. If Mort�a�ee requ�ires,such inspection shall also include a records search and/or subsurface
<br /> -�"�'� testing for the presence of Hazardaus Substances in the soil,sub�oil,bedrock,surtace water andiur
<br /> -- - gr.oundwater. If said audit report indicates the presence of any Hazardous Substance or Release or
<br /> - - the threat of a Release on,at or from the Real Pruperty,Mortgagor shall prompdy undertake and
<br /> =,y,� diligeniy pursue to completion all necessary, appropriate and legally authoriud investigative,
<br /> _ -- containment,removal,clean up and other remedial actions,using methods recommended by the
<br /> - engineer or other person who prepared said audit report and acceptance to the appropriate federal,
<br /> =°^����^�- state and local agencies or authorities.
<br /> � (c) Mortgagor covenants and agrees,at Mortgago�'s sole cost and expcnse,to indernnify,
<br /> _ prot�ct,defend and save harmless each and every lndemnitee from and against any and alt damages,
<br /> -.�a� losses, liabilities,obligations, penatties, cluims, litigaiion,demands,defenses,judgments, suits,
<br /> --� .-___—_ actions,praceedings,costs,disbursements and/or expenses(including,without limitation,attomeys'
<br />-M:���-- and experts'fees,expenses and disbtusemeints)of any kind or nature whatsoever which may at any
<br /> .::>���� tiine be imposed upon, incurred by or asserted or awurdcd against any Indemnitee relating to,
<br />�,t'-�--='� resulting from or arising out of(a)the use of the R�eal Property for the storage,trr�tm�nt,generation,
<br /> =�_._�� tcansportation,processing,handling,production or disposal of any Hazardous Substanccs or as a
<br /> =�`� landfill or other waste disposal site or for military,mar�ufacturing or industrial purposes or for the
