<br /> 9.7 Annlica,� tion of Proceeds�'tpm Pro�, All proceeds realized from the exerc;ise of �
<br /> Mortgagee's xights and remedies shall lx applied as follows:
<br /> (a) To pay the costs of cxercising such rights and remedies, including the costs of
<br /> any sale, thc costs and expense of any receiver or Mortgagce-in-possessiun and the costs
<br /> and expenses provided f�r in Section 10.3;
<br /> (b) To pay indebtedneu;and
<br /> (c) The surplus,if any,shall be paid to the clerk of ihe court in the case of a fmcia�e
<br /> by a judicial proceeding,otherwise to the person or persons legally entided
<br /> thereta.
<br /> 10. ENVIRONMENTAL COMPLIANCE.
<br /> (a)The following terrns used in this Section 10 shall have the following meanings:
<br /> "Fnvi nrc�ment" mcans any water or water vapor,any land including land surface or
<br /> subsvriace,air,nsn,wildliiC,oivia:u►d�tI uutici iaoitil"'ai a�.aGilT��o•
<br /> "FnyimnmenL L.�ws"mean all federal,state and local environmental,land use,zoning,
<br /> health, chemical use, safety and ssu�itarion laws,statutes, ordinances and codes nlating to the
<br /> grotectiun of the Enviranment and/or governing tha use, storage, treatment, generation,
<br /> transportation,processing�handling,production or disposal of Hazardous Substanccs and the rules,
<br /> regulations,policies,guidelincs, intez}xetations,decisions,ordcrs and directives of federal,state and
<br /> local gove�unental agencies and authorities with nsjxct thereto.
<br /> �Fnvimnmentel Permiis mean all permits,licens�,approvals,authorizatiorLS,consents
<br /> or registrations required by any applicable Environmental Law in connection with iha owne�hip,
<br /> use andlor operation of the Real Property for the storage,treaYmeut generation, transpoatation,
<br /> processiIIg, handling, production or disposal of Hazar�ious Substances ar the sale, transfer or
<br /> conveyance of the Real Property.
<br />— "Ha�rdoLS�Lb�*�� " means,without Iimitation,any flammable explosives,radon,
<br /> radioactive materials, asbestos,urea formaldehyde foam insulation, polychlozinates biphenyls,
<br />= p�etroleum based prociucts, methaiie, ha¢ardous materials,hazardous wastes, hazardous or toxic
<br />- substances or related materials, as defined in th� Comprehensive Environmental Response,
<br />� Compensation and Liability Act of 1980, as amended (42 U.S.C. Secdons 9601, et sea.l, tht
