<br /> (a) Use, operate, manage, cantrol and conduct business on �the Praperty and muke
<br /> expendihues for all maintennnce and improvemer.ts as in its judgment ure praper;
<br /> (b) Collcct the income from the Property and appl;suGh sums to the exFenses of use, �
<br /> operation and nnanagement;and �
<br /> (c) At Mortgggee's option,complete any construction in prognss on the Property,and
<br /> in that connection pay bills,borrow funds,employ contractors and make any changes in plans or
<br /> specifications as Mortgagee dams appropriate.
<br /> If the revenues produced by the Pruperty are su�icient to pay expenses,the receiver may borrnw,
<br /> from Martgagee(if Mortgagee,in its sole discretiion,agrees to lend)or otherwise,or Mortgagee may
<br /> borrow or advance,such sums as thc receiver or Mortgagee may dcem necessary far the purposes
<br /> stated in this garagraph. The amounts borrowed or advanced shall bear inter�st from the date of
<br /> expenditure until nQaid at the same interest rate as provided in Section 10.3 below. Such sums shall
<br /> bxome a part of thc indebtedness sccured by this Mortgage and shall be payable by Mortgagor on
<br /> demand.
<br /> 9.3 S te of�Pro�, In exercising its rights and remedies,Mortgagee may cause all or
<br /> any part of tbe Property to be sold as a whole or in garcels,and certain portions o�the Property mny
<br /> be sold without selling other portions. Mortgagee may bid at any publir,sale on all or any portion
<br /> of the Property.

<br /> of any public sale of any personal pmpert}►or of the time a.fter which any private sale or ottxr

<br /> g,s Wa•_ver �ecion of Remedies. A waiver by either party of a bre�ch of a provision of
<br /> this Mortgage shall not constitute a waiver of or prejudice the periy's right othrrwise to d�emand strict
<br /> �omgliance with that provision or sny otha provision. Election by Mortgagee to pursue any
<br /> remedy shall not cxclude pursuit of any other remedy,aad all rtmedies of Mortgagee under this
<br /> Niortgage are cumulaiive and not exclusive. An election to make experiditures or to take action to
<br /> �erform an obligation of Mortgagor shall not affect Mortgagee's right to declac+� a default and
<br /> axercisa its rcmcdies under this Mortgage.
<br /> 9.6 Att���.Fees:Exnenses_. In the evant suit or action is instituted to enforee any of the
<br /> terms�f this Mortgage, the prevailing party shall be rntitled to recover its reasonable attomeys's
<br />- f�es at trial,oa any appeal and on any petition for nview,in addition to all other sums provided by
<br /> law. Whetlxr or not any court action is izivolved,all expenses,inGluding reasonable attomeys'fees
<br /> incuned by Mortgagee that are necessary a4 an�time in Mortgagee's oginion f�r the protecticn of
<br />_ its interest or tha enforcement of its nights shall becomc a part of the indebtedness payable on
<br />- demand and shall bear interest from the clate of expenditure until repaid at the same intetest rate as
