<br /> material breach of or failure to perform any covenant madc by Mortgagor in this Agreement

<br /> (d) The liability r�f Mortgagor to each Indemnitee hereunder shall in no way be limited,
<br /> abridged,impaired or othervvise affected by(i)the repayment of all sums,and the satisfaction of all
<br /> obligations of the Mortgagor under the Note or th� Ag�eement, (ii) any foreclosure of this
<br /> � Instrument of the acceptance of a deed to the Real Propet�y iu lieu of foreclosure thercof,(iii)any -
<br /> amendment or modification of the Nate by or for the lxnefit of Mortgagor or any sub.5equent owncr

<br /> Mortgagor or any guarantor of the Note in any bankruptcy,insalvency,reorganizarion,anangement,
<br /> readjustment,composition,liquidation or similaz proceeding or(xiv)any other circumstances which
<br /> might otherwise consatute a legal or equitable release or dixtaarge,in whole or in pazt,of Mortgagor
<br /> under the Notc or of any guarantor of their obligations with nspect to the Note.
<br /> I1. MISCELLANEOUS
<br /> - 11.1 Subject to the limitations stated'ui this Mortgage
<br /> on transfcr of Mortgagor's interest,this Mortgage shal!be binding upon and inure to the benefit of
<br /> the parties,their successors and assigns.
